港口经营人的法律地位研究

【摘要】: 港口对促进国民经济的快速发展发挥了越来越重要的作用,然而,目前港口法律环境却存着与港口发展形势不相适应的地方。《港口法》虽然出台,遗憾的是该部法律仅仅调整了港口纵向的行政法律关系,对港口横向的民事法律关系却没现范,在港口经营过程中产生的民事法律问题适用运输法律还是适用一般的民法和合同法,仍是需要迫切回答的问题。港口经营人的法律地位是解决港口民事法律关系的基础,结合我国港口经营人的实际,深入研究港口经营人的法律地位,具有重要的理论与实践意义。本文试图做这方面的探索。 本文第一章介绍港口经营人的定义,比较国际公约,英美法及我国法律对港口经营人定义的不同,分析了我国港口经营人的范围。 第二章分析了港口经营人法律地位的立法状况,对国际公约、英美法、我国法律法规中港口经营人的法律地位进行比较,然后分析我国的立法现状。 第三章介绍了理论和司法审判实践中出现的对港口经营人法律定位的各种学说观点,并对主要的学说进行分析,赞成港口经营人是独立合同人的观点,并对海上履约人说进行了价值分析,提出《运输法草案》将从事与运输有关的港口经营人纳入海上履约人由运输法来调整的做法值得我们借鉴。 第四章提出解决我国港口经营人法律地位的立法建议,在我国《海商法》中引入海上履约人概念,将可以纳入海上履约人的港口经营人由《海商法》调整,不能由《海商法》调整的作为独立合同人,通过完善我国《港口法》,由《港口法》调整。
[Abstract]:The port has played a more and more important role in promoting the rapid development of the national economy. However, at present, the port legal environment is not suitable for the port development situation. Unfortunately, the law of the Ministry only adjusts the longitudinal administrative and legal relationship of the port, but it does not show up with regard to the horizontal civil legal relationship of the port. It is still an urgent question whether to apply the transportation law or to apply the general civil law and contract law in the process of port operation. The legal status of the port operator is the basis of solving the legal relationship of port civil affairs. It is of great theoretical and practical significance to study the legal status of the port operator in depth in combination with the reality of the port operator in our country. This article attempts to do this aspect of exploration. The first chapter introduces the definition of port operator, compares the definition of port operator between international conventions, Anglo-American law and Chinese law, and analyzes the scope of port operator in China. The second chapter analyzes the legislative status of port operators, compares the legal status of port operators in international conventions, Anglo-American law, and China's laws and regulations, and then analyzes the current situation of our country's legislation. The third chapter introduces the theory and judicial practice of the legal positioning of the port operator, and analyzes the main theories, agrees that the port operator is an independent contractor. This paper also analyzes the value of the maritime performing party, and puts forward that the method of bringing the port operator involved in the transport into the maritime performing party to adjust the maritime performing party by the transport law is worthy of our drawing lessons from the draft of the Transport Law. The fourth chapter puts forward the legislative proposal to solve the legal status of the port operator in China. The concept of maritime performing party is introduced into the Maritime Law of China, and the port operator who can be brought into the maritime performing party is adjusted by the Maritime Law. As an independent contractor who can not be adjusted by the Maritime Law, it is adjusted by the Port Law by perfecting the Port Law of our country.
