国家主管机关海难救助若干法律问题研究

【摘要】: 海难救助是海商法所特有的一项制度,而国家海上安全主管机关作为一国领海行使主权的主体,承担着维护辖区内航行安全和救助人命的特殊使命,因此,国家主管机关从事或控制的海难救助是海难救助制度中的一种比较特殊而重要的情况,但以往对此的相关研究并不多见。国家主管机关对海难救助的介入又使得海难救助的法律关系更加的复杂,尽管相关国际公约和国内法律法规对此做出了相应规定,在实践中对于国家主管机关在海难救助中的法律地位、法律关系、救助报酬请求权等方面仍然存在着诸多争议和误解。本文拟从国家主管机关海难救助的相关法律问题着手,结合国内外法律法规以及国际公约的相关规定,立足我国的救助实践,进行详细的探讨和论证,力求提出切实可行的解决问题的方法和建议。 本文共分五章对国家主管机关从事或控制的海难救助的相关法律问题进行探讨。第一章国家主管机关海难救助的法律渊源,主要是对国家主管机关从事或控制的海难救助的相关国内外法律和国际公约的规定进行概述;第二章和第三章是本文的重点内容,主要探讨了国家主管机关在海难救助中的法律地位,以及在国家主管机关从事或控制的海难救助中国家主管机关同一般救助人的法律关系,从而明确了国家主管机关从事海难救助行为的实际作用和重要意义:第四章探讨了国家机关从事或控制的海难救助中的救助报酬请求权问题,并探讨了实践中存在争议的可行性方法:第五章则概述了我国实践中存在的问题,并提出相应的解决问题的办法和建议。
[Abstract]:Salvage at sea is a special system of maritime law. As the main body of sovereignty in the territorial waters of a country, the national maritime safety authority undertakes the special mission of safeguarding the safety of navigation and saving human life within its jurisdiction. Salvage at sea which is engaged in or controlled by national competent authorities is a special and important situation in the system of salvage at sea, but there are few researches on it in the past. The involvement of the competent national authorities in the rescue of the sea makes the legal relationship of the salvage of the sea more complicated, although the relevant international conventions and domestic laws and regulations provide for this. In practice, there are still many disputes and misunderstandings about the legal status, legal relationship and the right of compensation for salvage. This article intends to start from the relevant legal issues of the national competent authority salvage at sea, combine the domestic and foreign laws and regulations and the relevant provisions of the international convention, base on the salvage practice of our country, carry on the detailed discussion and argumentation, Try to put forward practical methods and suggestions to solve the problem. This article is divided into five chapters to discuss the relevant legal problems of salvage at sea. The first chapter is the legal source of salvage by the national competent authority, which is mainly an overview of the relevant domestic and foreign laws and the provisions of the international conventions on salvage at sea that the competent authorities engage in or control. The second and third chapters are the key contents of this paper. This paper mainly discusses the legal status of the national competent authority in salvage at sea, as well as the legal relationship between the competent authority of the state and the general rescuer in the rescue of the maritime disaster that is carried out or controlled by the competent authority of the state. So it makes clear the actual function and important significance of the national competent authorities engaged in salvage at sea. The fourth chapter discusses the right to claim compensation for salvage, which is engaged in or controlled by state organs. In chapter five, the problems in practice in our country are summarized, and the corresponding solutions and suggestions are put forward.
