【摘要】： 本文在历史唯物论的基础上，阐述了国际贸易法统一的进程。文中例举了对全球化具有重大意义的四个要素，自然法、商法实践、全球化和国际贸易组织，可以说，统一的进程就是这些因素的互动过程。国际贸易法可以分为公法部分与私法部分。私法部分因为是私人之间的贸易规则，所以本身就有着共同性，在主权国家出现以前它不能被称作国际贸易法，而只能被称作商人法。在15世纪，随着城市的消亡和主权国家的出现，，它被逐渐的融合到其它法律中去，但是即使如此，它的共同性仍然没有改变。当主权国家出现以后，国际贸易为了民族利益而处在主权国家控制之下，国际贸易法出现了。国际贸易公法当然成为国际贸易法的主体部分，而贸易法统一的问题就是主权的问题。随着经济的发展，世界步入全球化时代，全球化已触及到人们生活的方方面面，主权也被赋予了新的内涵与特性。各国都相应的改变了它们的国际贸易政策试图争取更多的合作，国际贸易法也将在新时代得到统一。
[Abstract]:On the basis of historical materialism, this paper expounds the process of unification of international trade law. In this paper, four factors of great significance to globalization, natural law, commercial law practice, globalization and international trade organization, are cited. It can be said that the process of unification is the interactive process of these factors. International trade law can be divided into public law and private law. Part of private law is the rules of trade between private individuals, so it has a commonality in itself. Before the emergence of a sovereign state, it could not be called international trade law, but only called merchant law. In the 15th century, with the demise of cities and the emergence of sovereign states, it was gradually incorporated into other laws, but even so, its commonality remained unchanged. After the emergence of sovereign states, international trade was under the control of sovereign states for the benefit of the nation, and international trade law appeared. Public law of international trade certainly becomes the main part of international trade law, and the unification of trade law is the question of sovereignty. With the development of economy, the world has stepped into the era of globalization. Globalization has touched every aspect of people's life, and sovereignty has been endowed with new connotations and characteristics. All countries have correspondingly changed their international trade policies in an attempt to win more cooperation, and international trade law will be unified in the new era.
