海上危险货物运输相关法律问题研究

【摘要】：作为海上运输领域的一个重要组成部分，海上危险货物运输的特殊性在航运界和海商法理论界一直倍受关注，引起的相关法律问题也成为近年来的研究热点。本文从海上危险货物运输的特点入手，将研究的总体框架置于民事法律关系之内，并结合了危险货物技术性法律规范以及相关行政法规的规定，同时借鉴国际公约、UNCITRAL最新运输法草案、航运发达国家的先进立法及英美法系国家的权威判例，重点对海运危险货物的定义和识别、海上危险货物运输的民事法律立法、海运危险货物承托双方的法律地位等方面做了具体的研究和分析。本文共分为四章。第一章介绍和分析了法律规范以及学理上关于海运危险货物的不同界定，并提出了我国《海商法》中应当采用的相关定义的建议，同时，对危险货物的具体识别也进行了详细阐述。第二章分析了国际国内有关海上危险货物民事立法的现状及发展趋势，并对海运合同及提单下的标准危险货物条款进行了基本介绍。第三章着重阐述了海运危险货物合同托运人的权利义务及责任承担，尤其对托运人的通知义务进行了详细分析，并特别针对航运实务中货运代理谎报、瞒报严重的情况及预防方法进行了法律层面上的探讨，初步提出了建立危险货物货运代理人资质制度的设想。第四章对海运危险货物承运人的特殊权利义务进行了分析，并根据平衡承托双方所负义务的考虑，，借鉴UNCITRAL运输法草案的最新规定，提出了应当规定危险货物承运人必须负担提供信息和指示义务的建议。本文不期另创新意，因为笔者一直走在前人开辟的路上，撰写过程中亦始终苦恼于实务知识的匮乏，惟希望闭门造车的一点小小设想，亦能够起到抛砖引玉的功用，内容如有谬误失当之处，尚祈不吝指正为祷。
[Abstract]:As an important part of the maritime transport field, the particularity of the maritime dangerous goods transport has been paid much attention to in the shipping and maritime law theoretical circles, and the related legal issues have also become the research hotspot in recent years. Starting with the characteristics of the transport of dangerous goods by sea, this paper puts the overall framework of the study within the civil legal relationship, and combines the technical legal norms of dangerous goods and the relevant administrative regulations. At the same time, drawing on the latest draft of the UNCITRAL Transport Law of the International Convention, advanced legislation of developed shipping countries and authoritative jurisprudence of common law countries, the emphasis is on the definition and identification of maritime dangerous goods and civil law legislation on the carriage of dangerous goods by sea. The legal status of the parties involved in the transport of dangerous goods by sea has been studied and analyzed in detail. This paper is divided into four chapters. The first chapter introduces and analyzes the legal norms and the different definitions of maritime dangerous goods in theory, and puts forward the relevant definitions that should be adopted in Maritime Law of China. At the same time, The specific identification of dangerous goods is also described in detail. The second chapter analyzes the current situation and development trend of the civil legislation on maritime dangerous goods at home and abroad, and introduces the standard dangerous goods clauses under the maritime contracts and bills of lading. The third chapter focuses on the rights, obligations and responsibilities of shippers in maritime dangerous goods contracts, especially the detailed analysis of shippers' notification obligations, especially in the light of the misrepresentation of freight forwarders in shipping practice. This paper discusses the serious situation and prevention methods from the legal level, and puts forward the tentative idea of establishing the qualification system of dangerous goods freight forwarders. Chapter four analyzes the special rights and obligations of the carrier of maritime dangerous goods, and draws lessons from the latest provisions of the draft UNCITRAL Transport Law according to the consideration of balancing the obligations of both parties. It was suggested that the carrier of dangerous goods should bear the obligation to provide information and instructions. This article will not create new ideas, because the author has been walking on the road opened up by his predecessors. In the process of writing, he has always been troubled by the lack of practical knowledge, but he hopes that a little bit of imagination, which is built behind closed doors, can also serve as a source of brick and jade.
