《中华人民共和国国际海运管理条例（送审稿）》研究

【摘要】： 航运业是国家国民经济活动的一个组成部分，对经济发展起着重要作用。随着我国由计划经济向市场经济的转型，，我国国际海运政策也在不断调整完善。交通部于2000年3月正式上报国务院的《中华人民共和国国际海运管理条例(送审稿)》，便是为适应形势发展，针对我国国际海运市场管理的实际需要，在总结我国国际海运市场管理经验，借鉴国外航运立法实践基础上而制定的规范国际海运经营活动的海运政策。 《中华人民共和国国际海运管理条例(送审稿)》作为《中华人民共和国海商法》的配套法规和21世纪我国水运交通法规体系中的骨干法规之一，明确体现了中央主管部门对国际海运管理方面明确的立法方向，发映出我国国际海运法规的国际化、市场化和规范化的趋势，对我国未来航运业的发展具有重要意义。 本文共分五部分。在分析《中华人民共和国国际海运管理条例(送审稿)》制定背景与起草原则的基础上，详细论述其框架结构和主要内涵，通过与相关法规比较，重点探讨它对我国海运立法的贡献，从而剖析《国际海运管理条例(送审稿)》的主要特征及对我国航运业发展的影响，并提出本人对修订和完善的若干建议，期望可以对完善我国海运立法尽绵薄之力。
[Abstract]:Shipping industry is an integral part of national national economic activities and plays an important role in economic development. With the transition from planned economy to market economy, China's international shipping policy is also being constantly adjusted and perfected. In March 2000, the Ministry of transport officially reported the State Council's regulations on the management of international shipping of People's Republic of China (Draft), In order to adapt to the development of the situation, in view of the actual needs of the international shipping market management in China, it is necessary to summarize the experience of the international shipping market management in our country and draw on the foreign shipping policy on the basis of foreign shipping legislation.
The People's Republic of China International Shipping Regulations (Draft) is one of the key regulations of the maritime law of People's Republic of China and one of the key regulations in the water transport traffic regulations system of China in twenty-first Century, which clearly reflects the clear legislative direction of the central authorities on the management of international maritime transport and the countries that reflect the international maritime laws and regulations of our country. The trend of internationalization, marketization and standardization is of great significance to the development of China's future shipping industry.
This article is divided into five parts. On the basis of the analysis of the setting up and drafting principles of the regulations on the management of People's Republic of China international shipping, the framework and the main connotation are discussed in detail. By comparing with the relevant laws and regulations, the contribution of the regulations to the legislation of China's maritime transport is emphatically discussed, so as to dissect the international shipping regulations (Draft). The main features and the impact on the development of China's shipping industry, and put forward some suggestions for revision and improvement, and expect to make a great effort to improve our country's shipping legislation.
