海上保险利益的法律问题分析

【摘要】： 保险利益是保险法中的一个重要概念,海上保险利益由于其特殊性也需要进行特别研究。在世界上,海上保险利益存在诸多法律问题,比如海上保险利益的适用条件、时间效力、享有人、转移等等,各国法学界的学者也都依照各自国家的法律对海上保险利益的立法和理论进行着讨论。本文以中国法为基础,着重讨论海上保险利益在我国的立法情况、理论、以及实践中遇见的问题,并结合我国最新颁布的《物权法》,对海上保险利益可能出现的新问题进行分析讨论。 全文分为五章对海上保险利益的法律问题进行探讨: 第一章,主要针对保险利益的概论和基本问题进行阐释、讨论和分析。本章着重对保险利益的概念和适用条件进行了分析,提出了保险利益的广义和狭义概念新见解。 第二章,对海上保险利益的基本问题进行了研究和讨论。以普通的财产保险利益为参照,介绍了海上保险利益的特殊性,并对海上保险利益的时间效力和转移等问题进行了研究。 第三章,对海上保险利益按照实务进行分类研究。具体对船舶保险、海上货物运输、运费保险、、责任保险、海上再保险、船员工资和其他报酬以及共同被保险人的保险利益进行了讨论。 第四章,讨论《物权法》对海上保险利益的可能影响。具体分析了船舶所有权转移、提单质权人、船舶留置权相关的海上保险利益可能出现的新情况,此均为笔者的新见解。 第五章,总结我国目前对于海上保险利益的规定的现状和不足,对《保险法》和《海商法》提出建议。
[Abstract]:Insurable interest is an important concept in insurance law. Because of its particularity, marine insurance interest also needs special research. In the world, there are many legal problems in the interests of marine insurance, such as the applicable conditions of marine insurance interests, the effect of time, the enjoyment of persons, the transfer and so on. Scholars of various countries also discuss the legislation and theory of marine insurance interests according to their respective laws. Based on Chinese law, this paper focuses on the legislative situation, theory and practice of marine insurance interests in China. Combined with the newly promulgated Real right Law in China, the possible new problems of marine insurance interests are analyzed and discussed. The full text is divided into five chapters to discuss the legal issues of marine insurance interests: the first chapter is mainly about the introduction of insurance interests and the basic issues of interpretation, discussion and analysis. This chapter focuses on the analysis of the concept and applicable conditions of insurance interest, and puts forward the broad and narrow concept of insurance interest. In the second chapter, the basic problems of marine insurance interest are studied and discussed. In this paper, the particularity of marine insurance interest is introduced, and the time effect and transfer of marine insurance interest are studied. The third chapter, the marine insurance interests according to the practice of classification. This paper discusses the marine insurance, marine cargo transportation, freight insurance, liability insurance, marine reinsurance, crew wages and other remuneration, as well as the insurance interests of the co-insured. Chapter four discusses the possible influence of Real right Law on marine insurance interests. This paper analyzes the possible new situation of ship ownership transfer, bill of lading mortgagee, and marine insurance interests related to ship lien, all of which are the author's new opinions. Chapter five summarizes the present situation and deficiency of marine insurance interests in our country, and puts forward some suggestions on insurance law and maritime law.
