论海运提单项下的提货权及其运用

【摘要】:承运人无单放货问题是一个长期以来始终存在颇多争议的法律问题,由此出现了各种不同的观点和针对相似案件的不同判决。本文试图通过对我国《海商法》相关规定的分析,,引申出海运提单项下的提货权的概念,并针对这一权利的理论问题进行阐述,从而为解决这些法律问题提供一定的理论参考。 本文第1章从我国《海商法》的规定出发,比较分析相关法律规定,引伸出海运提单项下提货权的概念。第2章论述海运提单项下提货权的来源,比较分析了有关海运提单项下提货权来源的不同观点,并提出了自己的主张。第3章论述海运提单项下提货权的属性,结合海运提单项下提货权的特点论述了提货权的债权性,并分析了提单质押时权利质权的标的及其性质。第4章结合我国法律的规定论述了主张提货权的条件,并特别分析了指示提单情况下提货权的权利主体及对提单持有人的正确理解。第5章分析了海运提单项下提货权行使的相关问题。第6章将海运提单项下提货权的理论运用到无单放货问题的分析中,指出无单放货侵犯的客体是提货权,提出无单放货赔偿请求的人必须具有提单项下的提货权。
[Abstract]:The carrier's delivery of goods without bill is a controversial legal issue for a long time, resulting in different viewpoints and different judgments on similar cases. Through the analysis of the relevant provisions of Maritime Law of China, this paper attempts to extend the concept of the right to pick up goods under the bill of lading, and to expound the theoretical problems of this right, so as to provide a certain theoretical reference for solving these legal problems. The first chapter of this paper starts from the provisions of China's Maritime Law, compares and analyzes the relevant legal provisions, and extends the concept of the right to pick up goods under the maritime bill of lading. Chapter 2 discusses the origin of the right to pick up goods under the bill of lading, compares and analyzes the different viewpoints of the right of delivery under the bill of lading, and puts forward its own opinion. The third chapter discusses the property of the right to pick up goods under the bill of lading, discusses the creditor's rights of the right of delivery according to the characteristics of the right of delivery under the item of bill of lading, and analyzes the object and nature of the right of pledge when the bill of lading is pledged. Chapter 4 discusses the conditions of the right to pick up goods in combination with the provisions of Chinese law, and especially analyzes the subject of the right to pick up goods and the correct understanding of the holder of the bill of lading in the case of instructive bill of lading. Chapter 5 analyzes the related problems of the right of delivery under the bill of lading. Chapter 6 applies the theory of right of delivery under bill of lading to the analysis of the problem of delivery without bill of lading, and points out that the object of non-bill of lading infringement is the right to pick up goods, and the person who puts forward the claim for delivery of goods without bill of lading must have the right to pick up goods under bill of lading.
