关于全损的法律问题研究

【摘要】： 英国在海上保险市场有着重要的地位和影响，毋庸置疑，，我国的保险法律制度和保险实践也受到英国的巨大影响。所以，本文通过对英国海上保险法中有关全损、特别是推定全损和委付的法律制度的系统分析，通过将其与我国海上保险法律和实践中相关法律制度进行比较研究，达到对有关全损的法律问题有一个全面和深入的理解，着重指出我国的有关全损、特别是推定全损和委付制度的规定中存在的问题，最终对我国《海商法》中关于全损的法律规定提出修改建议。相信会有助于一些相关的保险合同纠纷的解决，有助于我国海上保险法律制度完善。
[Abstract]:Britain has an important position and influence in the marine insurance market. There is no doubt that China's insurance legal system and insurance practice are also greatly influenced by the United Kingdom. Therefore, this paper makes a systematic analysis of the total loss, especially the constructive total loss and abandonment, and compares it with the relevant legal systems in China's marine insurance law and practice. Reaching a comprehensive and in-depth understanding of the legal issues relating to total losses, and stressing the problems existing in the provisions of our country regarding total losses, in particular the system of presumption of total loss and abandonment, Finally, some suggestions are put forward to amend the law of total loss in Maritime Law of our country. It is believed that it will be helpful to resolve some related disputes of insurance contract and to perfect the legal system of marine insurance in China.
