电子商务特殊法律问题研究

【摘要】： 世界已经进入信息时代。计算机与通讯技术的融合与发展所引起的人类社会的变革之一，就是商事交易的电子化、网络化。电子商务的迅速崛起与广泛应用，，促成了电子商务法的形成与发展。这是商法制度反映商事交易规则的必然要求。纵观全球，从发达国家到一些发展中国家，都纷纷制定了电子商务法，以保障和促进电子商务这一新兴市场和相关产业的蓬勃发展。联合国和其他一些国际组织，为了迎接全球电子商务时代的到来，也正在积极制定国际性的电子商务规则。因而，对电子商务特殊法律问题的研究，对于我国的电子商务的发展及立法有重大现实意义。
[Abstract]:The world has entered the information age. One of the changes in human society caused by the integration and development of computer and communication technology is the electronic and network of commercial transactions. The rapid rise and wide application of electronic commerce have contributed to the formation and development of electronic commerce law. This is the inevitable requirement that the commercial law system reflects the commercial transaction rules. All over the world, from developed countries to some developing countries, e-commerce laws have been formulated to ensure and promote the vigorous development of e-commerce, an emerging market and related industries. The United Nations and other international organizations, in order to meet the advent of the global e-commerce era, are also actively formulating international e-commerce rules. Therefore, the study of special legal issues of electronic commerce is of great practical significance to the development and legislation of electronic commerce in our country.
