中国古代有商法吗——对“重本抑商”的历史思辩

【摘要】：作为私法文化的商法在中国古代已经存在，由于大陆农业文明决定着我国古代商法呈现出与欧洲海洋文明下的传统商法迥然不同的态势，在“重本抑商”思想的影响下，我国古代商法呈“之”字型发展轨迹，，并导致官商现象的长期存在。因此，在探讨中国古代商法时，我们不能机械地比照欧洲商法内容，方枘圆凿；在移植西方现代商法时，我们应充分考虑中国国情，不能削足适履
[Abstract]:Commercial law, as a private law culture, already exists in ancient China. Because the agricultural civilization of the mainland determines that the ancient commercial law of our country presents a very different situation from the traditional commercial law under the European marine civilization, under the influence of the thought of "emphasizing the original and restraining the business", the ancient commercial law of our country presents the "shape" development track, and leads to the long-term existence of the official and commercial phenomenon. Therefore, in the discussion of ancient Chinese commercial law, we can not mechanically compare the content of European commercial law, square pedestal chisel; in transplanting western modern commercial law, we should fully consider China's national conditions and can not cut our feet and act properly.
