我国宪法监督程序制度之审思与变造

【摘要】：我国宪法监督程序是在宪法性法律内设定的,主要集中于《全国人民代表大会组织法》和《立法法》。然而,我国宪法监督程序对于公民基本权利保障与宪法权威树立并未发挥其应有的作用,故有必要从程序设定的监督主体、程序设定的场景与提起主体、程序监督的客体及其合理性等方面审思程序失效之因,并提出改革的新路径。
[Abstract]:The constitutional supervision procedure of our country is set in the constitutional law in, mainly concentrated in the "National People's Congress organization law" and "legislation law. However, the procedure of constitutional supervision in China for the protection of basic civil rights and constitutional authority does not play its due role, it is necessary from the supervision of the main program set by the program set the scene with the subject, object and procedure supervision and other aspects of the rationality examination procedures for the failure, and puts forward a new path of reform.
