【摘要】：近些年，我国房地产经济不断发展，住房制度改革也不断深入，房地产交易日趋频繁和活跃，商品房消费已成为人们生活中重要的消费行为。然而，和飞速发展的房地产经济形成反差的是我国相关法律、全民维权意识的薄弱以及房地产市场中不规范的现象，这些方面直接联系商品房消费者的生命财产安全权、公平交易权等，从而严重影响消费者基本权利的实现，进而为房地产行业发展埋下隐患。商品房消费者在选择和购买商品房过程中，因缺乏权利保护意识和相应的信息知识，很大程度地依赖商品房经营者。而商品房经营者和消费者的利益关系是对立的，因此，商品房经营者会利用这些依赖，对商品房消费者提供较少的信息，从而达到利益的最大化，最终导致商品房消费者在交易活动中的利益损害和丧失。商品房消费者的生命财产安全权、公平交易权等权益受到严重损害是因为对其知情权的保护不完善。因此，保护商品房消费者的利益，维护房地产市场的发展，关键在于建立完善的商品房消费者知情权保护机制。本文第一部分“商品房消费者知情权的一般内容”首先介绍商品房、消费者知情权的含义，，接着分析商品房消费者知情权的内涵。本文第二部分从国家、商品房消费者自身、房地产市场等方面作出分析论证商品房消费者知情权被侵犯的主要表现。本文第三部分从商品房消费者知情权受侵害的法律制度因素出发，逐步分析《消费者权益保护法》、《商品房司法解释》、《城市土地管理法》、《产品质量法》等法律制度的不足。本文第四部分,则以制度保护为主线，对法律制度保护、行政制度保护、司法制度保护、社会保护等四种保护提出完善的建议，进而构建商品房消费者知情权的保障体系。本文第五部分，对全文进行总结并归纳观点。
[Abstract]:In recent years, China's real estate economy development, housing system reform has been deepened, real estate transactions have become increasingly frequent and active, commercial housing consumption has become an important consumer behavior in people's lives. However, with the rapid development of real estate economy is a contrast of China's relevant laws, not standard phenomenon universal rights consciousness the weak and the real estate market, the real estate consumer directly linked to the life and property safety, which seriously affected the right even bargain, the realization of the basic rights of consumers, and for the development of the real estate industry lay hidden.
Commercial housing consumers buy commercial housing in the selection and process, due to lack of awareness of rights protection and the corresponding information knowledge, largely dependent on commercial housing and commercial housing operators and operators. The relationship between the interests of consumers is the opposite, therefore, real estate operators will use these dependencies, provide less information on commercial housing consumers. In order to achieve the maximization of interest, resulting in damage to the interests of the transactions in the real estate consumer and commercial housing consumers. The loss of life and property safety, even bargain rights suffered serious damage because of the rights protection is not perfect. Therefore, the protection of housing safeguard the interests of consumers, the development of the real estate market the key is to establish, perfect real estate consumers' right protection mechanism.
The first part of the article is "the general content of consumer's right to know in commercial housing" first introduces the meaning of commercial housing and the right to know, then analyzes the connotation of the right to know of commercial housing consumers.
The second part of this paper analyzes the main manifestations of the infringement of the right to know of the commercial housing consumers from the state, the consumer of the commercial housing and the real estate market.
The third part of this article starts from the legal system factors of consumers' right to know in commercial housing, and gradually analyzes the shortcomings of the consumer rights protection law, the commercial housing judicial interpretation, the urban land management law and the product quality law.
The fourth part of this paper, the system of protection as the main line, the legal system of administrative protection, system protection, judicial protection system, puts forward the suggestions for improving social protection and other four kinds of protection and construction of commercial housing consumer right to know the security system. The fifth part of this paper, summarizes the thesis and summarize the views.
