网络表达自由的保障与限制

【摘要】：表达自由是公民最基本的权利,尤其是在现代社会作为基本人权的表达自由是公民充分地表达自己的意见、建议和观点的一个重要渠道,在宪法和法律层面给予表达自由以真正的保护是世界各国的普遍做法。表达自由有多方面的外在价值和自身价值,在发现真理和追求真知以及自我实现上都有自己独特的一而,因而对表达自由的研究是当今世界各国的一个重要课题。随着互联网的兴起和快速发展,表达自由和网络开始结合在一起,使得网络成为表达自由交流和传播思想的新阵地,因而对网络表达自由的保障方面的研究成为亟需解决的问题,然而作为一种公民自由权,网络表达自由也不是不受限制的绝对自由,在一定条件下对网络表达自由给予一定的限制是必要的而且是必须的。本文试图在前人对表达自由的保障和限制的研究基础上作出新的理论探索与尝试,以期对当今中国表达自由的保障和限制的理论发展尽一点微薄之力。本文从新近发生的台湾中正大学副教授与朱学恒之间对“废除死刑”的争执作为引子,引出对网络表达自由权的属性以及如何平衡与其他权利冲突等问题的思考。第一部分是导论,主要分析了论文的研究目的,研究意义和国内外研究现状及发展趋势。第二部分是对表达自由的理论剖析,从表达自由的内涵、表达自由的价值以及表达自由的保障模式三个方面来加以论述,尤其是强调表达自由在发现真理和追求真知,推动民主政治以及公民的自我实现等方面的价值属性,而对表达自由的保障模式则是考察了当今世界两种保障模式,分析各自的利弊。第三部分则是从网络表达自由的特征、价值、内容和保障模式等几个方面来具体阐述网络表达自由,对各国网络表达自由保障的实践情况进行分析来寻求对我国有益的经验。第四部分是对限制表达自由的原则概括,这些原则包括明显与即刻危险原则、利益衡量原则、事后限制原则、表达内容中立原则和欧洲人权法院确立的限制表达自由的原则。第五部分则是从我国网络表达自由的保障的现状出发,找出当前保障所存在的问题,提出完善我国网络表达自由的某些建议。
[Abstract]:Freedom of expression is the most basic right of citizens, especially in modern society as the basic human rights of the freedom of expression is an important channel for citizens to fully express their views, suggestions and views. It is a common practice in the world to protect the freedom of expression in the constitutional and legal aspects. The freedom of expression has many external values and its own value. The research on freedom of expression is one of the most important subjects in the world. With the rise and rapid development of the Internet, the freedom of expression and the network began to combine together, making the network become a new position to express the free exchange and dissemination of ideas. Therefore, the research on the protection of the freedom of expression on the network becomes a problem that needs to be solved urgently. However, as a kind of civil freedom, freedom of expression on the network is not the absolute freedom without restrictions. It is necessary and necessary to restrict the freedom of expression on the network under certain conditions. This paper attempts to make a new theoretical exploration and attempt on the basis of the previous research on the protection and limitation of freedom of expression. In order to protect and limit the freedom of expression in China to do a little bit of theoretical development. This paper introduces the recent dispute between associate professor and Zhu Xueheng about the abolition of the death penalty in Zhongzheng University of Taiwan. The first part is the introduction, which mainly analyzes the purpose of the paper. The second part is the theoretical analysis of freedom of expression, from the connotation of freedom of expression. The value of freedom of expression and the guarantee mode of freedom of expression are discussed in three aspects, especially the emphasis on freedom of expression in the discovery of truth and the pursuit of true knowledge. Promoting democratic politics and self-realization of citizens and other aspects of the value of attributes, and freedom of expression of the security model is to examine the two security models in the world today. The third part is from the network freedom of expression characteristics, value, content and security model to elaborate the network freedom of expression. This paper analyzes the practice of guaranteeing freedom of expression in various countries in order to seek beneficial experience for our country. Part 4th generalizes the principle of restricting freedom of expression, which includes the principle of obvious and immediate danger. The principle of interest measurement, the principle of post-limitation, the principle of expressing content neutrality and the principle of restricting freedom of expression established by the European Court of Human Rights. Part 5th is based on the status quo of the guarantee of freedom of expression on the Internet in China. This paper finds out the problems existing in the current security, and puts forward some suggestions to improve the freedom of expression in China's network.
