农村集体经济组织成员资格认定问题研究

【摘要】：近年来,随着国家城镇化、工业化的稳步推进,高速公路、商品房等大型项目的开发与建设占用了大量城乡结合部的农用土地、宅基地等。伴随着土地被征收而引发的拆迁安置补偿纠纷、土地征收补偿分配费用等纠纷层出不穷。其中,关于土地征收补偿分配费用的纠纷最为典型,其具有数量多、涉及面广、政策性强、社会敏感度高以及法院处理难度大等特点。由于该类纠纷大多涉及到农村集体组织成员资格的认定,而当前我国农村集体经济组织成员资格的认定没有统一的标准,尚未出台相关立法。村委会或村民小组出于对利益的诱惑以及家族势力等因素的影响,披着所谓代表民意的外衣,它们将某些人员排除在分配范围之外,拒绝向其支付土地补偿款。被剥夺成员资格人员往往对成员资格认定标准提出质疑,继而诉诸法院。而司法实践中法院又以该类案件涉及成员资格的认定而不予受理,或者有的法院认为成员资格认定属于村民自治的权限,司法不宜直接介入。由于当事人状告无门,被迫无奈而选择上访,甚至围攻法院。成员资格认定标准的不统一以及“农村集体经济组织成员资格认定纠纷”不受理的现状,不利于保障失地农民的合法权益,不利于农村的稳定发展,不利于社会的和谐,更与当前的司法公平、公正原则格格不入。本课题的研究有利于保护农民的合法权益,促进农村有序、稳定、健康发展。本文提出了将农村集体经济组织成员资格认定单独立法的合理性以及赋予成员资格认定纠纷当事人起诉的权利,丰富了农村集体经济组织成员资格认定的具体标准。研究该论题对今后司法实务部门处理类似案件具有一定的启发和实践意义。全文共分为三个部分:第一部分,以三个较为典型的土地补偿款分配纠纷案例引出本文所要讨论的问题,也即是当前农村集体经济组织成员资格认定存在的问题——分别是集体经济组织成员资格认定标准不统一、“成员资格认定纠纷”受理情况不统一。第二部分,通过当前司法实践中存在的几种成员资格认定的标准进行了评析,分别分析了当前成员资格认定标准不统一、“成员资格认定纠纷”受理情况不统一的原因,为完善建议部分做好铺垫。第三部分,对集体经济组织成员资格认定标准不统一、“成员资格认定纠纷”受理情况不统一提出了完善的建议、意见,尤其是丰富了对一些特殊人员如婚嫁人员、空挂户等成员的认定。从司法实务部门可操作性的角度,提出应当赋予此类案件可诉性的建议以及从诉的理论方面对此类案件进行了分类,以期对农村集体经济组织成员资格认定问题研究有所裨益。
[Abstract]:In recent years, with the country urbanization, the steady progress of industrialization, highway, commercial housing and other large-scale projects of development and construction occupied a large number of urban and rural areas of agricultural land. With the land expropriation caused by the removal of compensation disputes, land expropriation compensation and distribution of disputes emerge in endlessly. Among them, the most typical dispute about land expropriation compensation allocation costs. It has many characteristics, such as large quantity, wide coverage, strong policy, high social sensitivity and difficult to deal with by the court. Because this kind of dispute mostly involves the identification of the membership of rural collective organizations. At present, there is no unified standard for the membership of rural collective economic organizations in China, and no relevant legislation has been issued. The village committee or the villagers' group is influenced by factors such as the temptation to benefit and the influence of the family influence and so on. Dressed as a so-called representative of public opinion, they exclude certain persons from the scope of their distribution and refuse to pay them land compensation. Persons deprived of membership often question the criteria for membership. Then resort to the court. And in judicial practice, the court will not accept this kind of cases because of the membership, or some courts think that membership is the jurisdiction of villager autonomy. The justice should not intervene directly. Because the litigants have no way to sue, they are forced to choose petition because of their helplessness. Even besieged the court.The disunity of the standard of membership and the non-acceptance of the dispute of membership in rural collective economic organizations are not conducive to the protection of the legitimate rights and interests of landless peasants. It is not conducive to the stable development of rural areas, social harmony, but also against the current principles of justice and justice. The study of this topic is conducive to the protection of the legitimate rights and interests of farmers, to promote order and stability in rural areas. Healthy development. This paper puts forward the rationality of the separate legislation on the membership of rural collective economic organizations and the right to sue the parties to the dispute. It enriches the specific criteria of membership recognition of rural collective economic organizations. The research on this topic has certain inspiration and practical significance for the judicial practice departments to deal with similar cases in the future. The full text is divided into three parts:. Part one. With three more typical cases of land compensation allocation disputes, this paper will discuss the issues to be discussed. That is, the current rural collective economic organization membership of the existing problems-respectively, the collective economic organization membership criteria are not unified, "membership identification dispute" is not uniform. Part two. Through the analysis of several kinds of standards of membership confirmation in the current judicial practice, this paper analyzes the reasons why the current standards of membership confirmation are not unified and the acceptance of "membership qualification dispute" is not uniform. In order to perfect the suggestion part, the third part, put forward the perfect suggestion and opinion to the collective economic organization member qualification confirmation standard is not unified, the "member qualification confirmation dispute" accepts the situation to be not unified. Especially has enriched to some special personnel such as the marriage personnel, the empty hanging door and so on member's confirmation. From the judicial practice department maneuverability angle. This paper puts forward some suggestions that should be granted the justiciability of this kind of cases and classifies them from the theory of litigation in order to be helpful to the study of the membership of rural collective economic organizations.
