农村儿童受教育权的宪法保护

【摘要】：受教育权是公民依法享有的,要求国家积极提供平等的受教育机会和条件,以获得平等的生存和发展机会的基本权利。同时,它也是国际人权法和大多数国家宪法予以明确的一项基本人权。“受教育机会权”、“受教育条件权”、“受教育平等权”、“公正评价权”是受教育权的基本内容。我国虽然已经形成了一定程度的教育法律体系,但目前对农村儿童受教育权的法律保护却存在法律规定不明,且缺乏可操作性;教育行政部门执法不力,缺乏完善的教育监督体系;受教育权救济途径不畅等问题。法律保护的乏力,归根结底是由于缺乏宪法精神的指引,受教育权这项宪法基本权利亟需宪法保护。可以说,农村儿童受教育权的宪法保护是保障受教育平等权的必然要求、实现人的全面发展的客观需要、强化国家义务的现实需要。为此,应以宪法上的受教育权为原则来完善保护农村儿童受教育权的立法,规范教育执法,并有必要在中国建立司法化的违宪审查制度,当然,这不可能一蹴而就。现阶段,可通过依宪解释实现农村儿童受教育权在普通诉讼中的宪法保护。
[Abstract]:The right to education is enjoyed by citizens in accordance with the law and requires the State to actively provide equal opportunities and conditions for education in order to obtain the basic right to equal opportunities for survival and development... at the same time. It is also a fundamental human right enshrined in international human rights law and in the constitutions of most countries... "the right to education", "the right to conditions of education" and "the right to equality in education". The right to fair evaluation is the basic content of the right to education. Although China has formed a legal system of education to a certain extent, the legal protection of the right to education of rural children is unclear. And lack of maneuverability; The education administrative department does not enforce the law effectively, lacks the perfect education supervision system; The lack of legal protection is ultimately due to the lack of guidance from the spirit of the Constitution. The right to education, the basic constitutional right, is in urgent need of constitutional protection. The constitutional protection of rural children's right to education is the inevitable requirement of ensuring the right to education equality, the objective need to realize the all-round development of human beings, and the practical need to strengthen the national obligation. We should take the constitutional right to education as the principle to perfect the legislation to protect the rural children's right to education, standardize the education law enforcement, and it is necessary to establish a judicial review system of unconstitutional in China, of course. At this stage, the constitutional protection of rural children's right to education in ordinary litigation can be realized through constitutional interpretation.
