农民结社自由研究

【摘要】：目前，在我国几乎所有的社会群体都有自己的正式、合法的群体组织，这些组织不仅能有效整合和表达不同社会成员的利益要求，维护各自群体的权益，，而且还发挥着监督政府以及影响政府政策的制定、提高该群体整体的话语权的功能。而惟独占全国人口绝大多数、处于最弱势地位的农民却没有组织起来，缺少了属于自己的全国性合法代言组织，农民由于没有自己的社团组织而显得更为自由涣散和难于聚合，其权利也处于受损的状态，这也是我国“三农”问题产生和持续存在的根本原因所在。因此，“三农”问题的核心是人的存在和发展问题，是农民问题，而我国农民问题中最本质和核心的又是农民权利保障问题。农民权利的保障需要全社会的支持，而且尤其是需要农民自组织的支撑。结社自由作为现代宪法为公民确立的一项基本权利，农民的结社自由更应当受到保护，其中最基本的表现就是成立农会的权利。在我国要保障农民的结社自由，成立和发展农会组织，提高农民组织化的程度，根本出路或许还在于推动体制改革和制度创新。通过对我国农民组织的发展历程的梳理和对当代农民自我组织的实践考察，可以发现目前我国农民结社实践中还存在着法律性质与地位不明、自身发展与管理混乱、政社不分及目标偏差等问题，而导致这些问题产生的原因既有认识和观念层面的，也有立法、管理体制和司法保障等制度层面的。因而要从根本上保证农民合法权益得到切实地尊重和实现，保障农民能够真正充分享有平等的经济、政治、社会和文化权益，就必须从转变传统的观念和认识、完善农民结社自由保障立法、改革现行社团管理体制和完善农民结社自由的司法保障等方面着手，推动农民结社自由的法治化进程。
[Abstract]:At present, almost all social groups in our country have their own formal and legal group organizations. These organizations can not only effectively integrate and express the interests of different social members, and safeguard the rights and interests of their respective groups. And it also plays a role in supervising the government and influencing the formulation of government policies to improve the overall voice of the group. But only the majority of the population in the country, in the most vulnerable status of farmers have not been organized. Lack of their own national legal endorsement organizations, because of the lack of their own organizations, farmers appear more free and loose and difficult to converge, their rights are also in the state of damage. Therefore, the core of the problem of "agriculture, rural areas and farmers" is the problem of human existence and development, which is the problem of farmers. The most essential and core of the peasant problem in China is the protection of farmers' rights. The protection of farmers' rights needs the support of the whole society. The freedom of association is a basic right established by the modern constitution for citizens, and the freedom of association of farmers should be protected. One of the most basic manifestations is the right to form peasant associations. In our country, we should guarantee the freedom of association of farmers, set up and develop peasant association organizations, and improve the degree of farmers' organization. The basic way out may also lie in promoting the system reform and system innovation. Through combing the development course of the peasant organization in our country and investigating the practice of the contemporary peasant self-organization. It can be found that there are still some problems in the practice of farmers' association in our country, such as unclear legal nature and status, confusion in their own development and management, lack of distinction between government and society, and deviation of objectives and so on. The causes of these problems are not only the understanding and concept level, but also the system level of legislation, management system and judicial guarantee. Therefore, the legitimate rights and interests of farmers should be guaranteed to be respected and realized. In order to ensure the farmers to enjoy equal economic, political, social and cultural rights and interests, we must change the traditional concept and understanding, and perfect the legislation of farmers' freedom of association. Reform the current management system of associations and improve the judicial guarantee of farmers' freedom of association, so as to promote the process of the rule of law of peasants' freedom of association.
