居住自由权入宪与农民集中居住的良性推进

【摘要】：公民的居住自由权与迁徙自由权关系密切而又是不同的概念。由于居住自由权在我国当前宪法中缺位,一些地方政府在城乡一体化改革的进程中强迫农民集中居住无所顾忌,这种行为忽视了"自由"信念而来源于家长主义式干预的思想。居住自由权入宪则在一定程度上意味着地方政府推进农民集中居住的行为将受到宪法上的约束,从而有利于农民集中居住的良性推进。
[Abstract]:The right to freedom of residence and the right to freedom of movement are closely related and different concepts. Due to the absence of the right to freedom of residence in the current constitution of our country, some local governments have forced farmers to live in a centralized manner in the process of urban-rural integration reform. This behavior ignores the belief of "freedom" and originates from the idea of paternalistic intervention. To a certain extent, the entry of the right to freedom of residence means that the behavior of local government to promote the concentrated residence of farmers will be restricted by the constitution, which is conducive to the benign advancement of the concentrated residence of farmers.
