论微博实名制对公民监督权的消极影响

【摘要】：自2011年底以来,我国各地开始推行微博实名制,并逐渐由各地方政府的分散做法变为国务院订立行政法规拟在全国范围内推行。我国的微博实名制的针对对象为我国新兴的以“微博客”为代表的社交网络服务。我国政府在制定微博实名的相关政策时,指出微博实名制旨在打击网上违法犯罪活动、净化网络环境、强化网民责任意识、推动诚信社会建设。然而微博实名制否定了网络的匿名性,严重影响了我国公民的言论表达自由进而影响到我国公民行使公民监督权。微博实名打破了互联网络网民身份平等的格局,是政府对公共领域的侵犯。微博实名制影响公民参政议政的主动性和积极性；强化了公权力机关对于微博上政治言论的监控；不利于提高政府工作质量,改善政府工作人员自身素质；不利于社会矛盾的化解,影响社会的稳定。本文综合运用案例研究法、文献研究法和跨学科综合研究的方法,对微博实名制的上述消极影响进行了论证。文章正文分别从公民监督权的理论基础、实施途径和监督效果三个方面分析了微博实名制实行可能带来的消极影响。并在第三部分讨论了微博实名制取消的必要性与可行性。通过对微博实名制和公民监督权相互关系的论证,试图说明微博实名制在我国推行还需要各种制度和法律规范的完善,对公民监督权产生抑制作用,现阶段不宜推行。
[Abstract]:Since the end of 2011, China began to implement the Weibo real-name system, and gradually from the decentralized practices of local governments into the State Council to make administrative laws and regulations to be implemented throughout the country. The real name system of Weibo in China is aimed at the emerging social network service represented by "Weibo guest". When our government formulates the policy of Weibo real name, it points out that the real name system of Weibo aims at cracking down on the illegal and criminal activities on the Internet, purifying the network environment, strengthening the sense of responsibility of Internet users, and promoting the construction of honest and honest society. However, the real name system of Weibo negates the anonymity of the network, which seriously affects the freedom of speech and expression of Chinese citizens and then affects the citizens' exercise of the right of civil supervision. The real name of Weibo breaks the pattern of identity equality of Internet users, and it is the government's violation of the public domain. The real name system of Weibo affects the initiative and enthusiasm of citizens to participate in politics and discuss politics, strengthens the monitoring of political speech on Weibo by public power organs, is not conducive to improving the quality of government work and improving the quality of government staff. Is not conducive to the resolution of social contradictions, affecting social stability. In this paper, the negative effects of Weibo real-name system are demonstrated by the methods of case study, literature research and interdisciplinary comprehensive research. The text analyzes the possible negative effects of the implementation of the Weibo real-name system from three aspects: the theoretical basis, the implementation approach and the supervision effect. In the third part, the necessity and feasibility of canceling Weibo real name system are discussed. Based on the demonstration of the relationship between the real name system of Weibo and the right of civil supervision, this paper attempts to explain that the implementation of the real name system of Weibo in our country still needs the perfection of various systems and legal norms, which has an inhibitory effect on the right of supervision of citizens, and is not suitable to be carried out at the present stage.
