论立法提案制度中的公众参与

【摘要】：立法提案作为立法程序的初始环节，也是极其关键的环节，完善公众参与立法提案的制度设计对整个立法的民主化程度具有十分重要的作用。公众参与在中国政治话语和学术界的流行使我们开始关注多元化社会环境下公众利益在立法上表达的需要和可能性。 本文以立法提案中公众参与的制度设计为中心论点。在了解立法提案、提案权主体归属等基本概念的基础上，对公民参与立法提案制度进行理论分析，，并根据瑞士的公众立法提案制度实践对公众参与立法提案的作用和影响进行深入的分析和考察。 在我国，“公众参与”应结合具体国情，在审视我国立法提案权归属现状及问题后，笔者提出在我国实行公众立法提案的必要性及有利条件，并在现有制度框架下进一步作出具体设计，为在我国立法提案制度中融入公众参与的力量进行可行性论证，以使民意得到充分的尊重和表达，立法程序更加民主科学化。
[Abstract]:As the initial link of the legislative process, legislative proposal is also an extremely critical link. It is very important to perfect the system design of the public participation in the legislative proposal for the whole degree of democratization of the legislation. The popularity of public participation in Chinese political discourse and academia makes us begin to pay attention to the need and possibility of legislative expression of public interest in the pluralistic social environment. This paper focuses on the system design of public participation in legislative proposals. On the basis of understanding the basic concepts of legislative proposal and the ownership of the subject of the proposal, this paper makes a theoretical analysis of the system of citizen participation in the legislative proposal. And according to the practice of the public legislative proposal system in Switzerland, this paper makes an in-depth analysis and investigation on the role and influence of public participation in the legislative proposal. In our country, "public participation" should be combined with the specific national conditions, after examining the status quo and problems of the ownership of legislative proposals in our country, the author puts forward the necessity and favorable conditions of carrying out public legislative proposals in our country. Furthermore, under the framework of the existing system, the author makes a detailed design to demonstrate the feasibility of incorporating the power of public participation in the legislative proposal system of our country, so that the public opinion can be fully respected and expressed, and the legislative procedure will be more democratic and scientific.
