农村集体建设用地使用权流转模式的立法设计

【摘要】：农村集体建设用地是我国社会主义土地改革成果的一部分,建国六十多年来,随着我国改革开放的不断深入,经济基础的进一步加强与完善,我国土地政策亦应该与时俱进,顺应时代潮流。我国从改革开放至今,对农村集体建设用地使用权流转的探索和研究,已取得一定的成效。在社会主义新阶段,必须要解决好的土地使用权流转问题。而对于农村集体建设用地使用权流转的法律保障,且如何将其作为建设社会主义法治社会的重要拼图,都是亟待解决的问题,同时也对中国今后的土地进一步优化格局、深化改革有着重大的意义和影响。而在社会主义市场经济不断深入发展的情况下,集体建设用地使用权流转的发展趋势将呈现多元化、市场化、规模化。那么,有完善的法律体系作保障,不仅会使农村集体建设用地使用权流转模式更加规范、合理,并且能有效杜绝随之衍生的贪污腐败问题。农村集体建设用地使用权的流转问题是近年来我国法律理论研究和实践中的热点问题,此关系到我国农村经济建设的重大部署和政策调整。因此,本文将围绕农村集体建设用地使用权流转如何立法、立怎样的法,即对其流转模式的立法构想展开进行论述,对我国典型的流转试点地区成果经验进行系统的阐述、评析。通过特殊到一般总结出符合我国国情的集体建设用地使用权流转模式,为我国其他地区的改革提供一定的借鉴。本文将分四章对农村集体建设用地使用权流转模式及其立法设计进行阐述。第一章阐述相关基本概况,包括对农村集体建设用地使用权流转涵义价值的重点介绍以及流转模式的梳理；第二章主要论述我国安徽芜湖、广东省及上海市的农村集体建设用地使用权流转的实践经验并对三地典型模式进行横向比较说明,最后对三地进行总结；第三章主要阐述各地流转模式的立法启示,从宏观上把握相关立法；第四章对农村集体建设用地使用权流转结合《宪法》、《土地管理法》、《物权法》的理解和修改方向给出具体立法建议。本文的目的：第一,对我国农村集体建设用地使用权典型流转模式试点地区的研究、为我国其他地区的相应改革树立典型,起到一定的借鉴作用。二是给国家立法机构建言献策、促进我国相关立法。
[Abstract]:Rural collective construction land is a part of the achievements of socialist land reform in our country. Since the founding of the people's Republic of China more than 60 years ago, with the deepening of reform and opening up and the further strengthening and improvement of the economic base, the land policy of our country should also keep pace with the times. Conform to the trend of the times. From the reform and opening up to now, the exploration and research on the circulation of rural collective construction land use right have achieved certain results. In the new stage of socialism, we must solve the problem of land use right circulation. However, the legal guarantee for the circulation of the right to use the rural collective construction land, and how to take it as an important puzzle for building a socialist society ruled by law, are all urgent problems to be solved. At the same time, it also further optimizes the pattern of land use in China in the future. Deepening reform has great significance and influence. With the development of socialist market economy, the circulation trend of collective construction land use right will be diversified, market-oriented and large-scale. Therefore, a perfect legal system can not only make the circulation mode of rural collective construction land use right more standardized and reasonable, but also effectively eliminate the corruption problem. The circulation of rural collective construction land use right is a hot issue in the research and practice of our country's legal theory in recent years, which is related to the major arrangement and policy adjustment of rural economic construction in our country. Therefore, this article will focus on the rural collective construction land use right circulation how to legislate, what kind of law, namely to its circulation pattern legislative conception to carry on the elaboration, to our country typical circulation pilot area achievement experience carries on the systematic elaboration, Comment. Through the special to general summing up the collective construction land use right circulation mode in accordance with the national conditions of our country, provide certain reference for the reform of other regions of our country. This article will be divided into four chapters on the transfer of rural collective construction land use right mode and legislative design. The first chapter describes the basic situation, including the transfer of rural collective construction land use right to focus on the value of the transfer and the circulation model of combing; the second chapter mainly discusses Wuhu, Anhui, China, The practical experience of rural collective construction land use right transfer in Guangdong Province and Shanghai, and the horizontal comparison of the three typical models, finally summarized the three places; the third chapter mainly expounds the legislative enlightenment of the circulation mode. The fourth chapter gives specific legislative suggestions on the understanding and modification of the circulation of rural collective construction land use right in combination with the Constitution, the Land Management Law and the Real right Law. The purpose of this paper is as follows: first, the study on the typical circulation model of rural collective construction land use right in our country will set up a typical model for the corresponding reform in other areas of our country and play a certain reference role.
