我国尊重和保障人权国家义务问题研究

【摘要】：随着社会的发展和我国法治建设的不断发展,以及2004年“国家尊重和保障人权”首次被载入中华人民共和国宪法,人权理念已逐步深入人心,人权保障问题亦成为关注的焦点。推动人权事业蓬勃发展,最基础的就是要确保做到尊重和保障人权,进而为促进人权实现和更好的发展建立良好的社会和法治环境。在尊重和保障人权方面,由于国家是权力行使者,以及其权力所具有的强制性等特点,所以人权面对的最大的威胁者是国家,但是对其最有力的保障者也为国家。因此,研究我国在履行尊重和保障人权的国家义务中的理论方面和现实方面的主要情况以及问题是十分必要的。 故本文以尊重和保障人权中的国家义务为研究对象,从尊重和保障人权语境下的国家与国家义务的基本内涵入手,确定论证框架,同时以国家作为尊重和保障人权义务主体的主要依据、尊重和保障人权语境下国家义务的主要分类、履行人权保障中的国家义务的主要原则等为基础,对于我国履行人权保障义务现状的问题及原因分析、与相关国际公约在的有关规定和域外国家的相关做法进行比较分析,提出完善建议等方面,探究人权保障中国家应当履行以及如何履行保障的义务,进而给予人权最有力的保障。
[Abstract]:With the development of society and the construction of the rule of law in our country, and the first time that "the state respects and protects human rights" was enshrined in the Constitution of the people's Republic of China in 2004, the concept of human rights has gradually been deeply rooted in people's hearts, and the issue of human rights protection has also become the focus of attention. To promote the vigorous development of human rights, the most basic thing is to ensure the respect and protection of human rights, and thus to establish a good social and legal environment for the promotion of the realization of human rights and the better development of human rights. In respect of respect and protection of human rights, because the state is the power executor and its power is compulsory, so the greatest threat to human rights is the state, but the most powerful guarantor is also the state. Therefore, it is necessary to study the main theoretical and practical aspects of our country's obligations to respect and guarantee human rights. Therefore, this article regards the state obligation in respect and protection of human rights as the object of study, starting with the basic connotation of the state and the state obligation in the context of respecting and protecting human rights, and determines the argumentation framework. At the same time, on the basis of the main basis of the State as the subject of the obligation to respect and protect human rights, the main classification of the obligations of the State in the context of respect and protection of human rights, and the main principles of fulfilling the obligations of the State in the guarantee of human rights, The problems and causes of China's implementation of its human rights protection obligations are analyzed, the relevant provisions of relevant international conventions and the relevant practices of foreign countries are compared and analyzed, and suggestions are put forward to improve the situation. This paper probes into how and how to fulfill the obligation of human rights protection, so as to provide the most effective protection for human rights.
