【摘要】：人类的生存和发展离不开食品这一最基本的物质条件,然而食品安全问题在我国已经成为广大人民群众普遍关注的社会问题,解决食品安全问题成为我国政府和企业所要面临的首要问题。要想解决食品安全问题,只依靠法律并不能够解决根本问题,只有将法律与伦理道德结合在一起,发挥道德“外塑于形,内化与心”的作用,方能从根本上解决食品安全问题。本文将现行的《食品安全法》中确定的食品安全法律规制体系作为研究对象,通过食品安全治理的伦理基础和法律基础,对我国食品安全伦理与法律规制的现状和存在的问题进行分析、探讨,并结合国外部分发达国家食品安全伦理与法律规制的成功经验,总结出完善我国食品安全伦理与法律规制的措施。根据此思路,本文分为五个部分：第一部分：绪论。阐述本文的研究背景、研究意义,介绍关于本论题的国内外研究情况,归纳论文研究方法,并分析文章可能的创新点,为全文的写作奠定基础。第二部分：食品安全伦理与法律规制的理论基础。以食品安全、食品安全伦理和法律的概念为基础,讨论食品安全伦理和法律的理论依据,为后文的研究提供理论基础。第三部分：我国食品安全问题的现状及成因分析。从中央和地方层面对我国的食品安全现状进行阐述,并对食品各个环节中存在的问题进行分析。第四部分：国外部分发达国家食品安全伦理与法律规制对我国的启示。通过分析部分发达国家如美国、加拿大等治理食品安全过程中的成功经验,从中得出改革和完善我国食品安全伦理与法律规制的启示。第五部分：完善我国食品安全伦理与法律规制的措施。通过以上四章的基础奠定,总结出缓解当前我国食品安全严峻形势的伦理和法律规制措施。
[Abstract]:The survival and development of human beings cannot be separated from the most basic material condition of food. However, the problem of food safety has become a social problem of widespread concern in China. Solving the problem of food safety has become the primary problem faced by our government and enterprises. To solve the problem of food safety, only relying on law can not solve the fundamental problem. Only by combining law with ethics and giving play to the role of morality in the form of "internalization, internalization and heart", can we fundamentally solve the problem of food safety. This paper will present the "food safety law" in the legal regulation of food safety system as the research object, through the ethical and legal foundation of food safety governance, analyzes and discusses the status quo of China's food safety ethics and legal regulations and problems, combined with the successful experience of foreign developed countries in food safety and ethics the legal regulation, summed up the improvement of China's food safety ethics and legal regulation measures. According to this idea, this article is divided into five parts: the first part: introduction. This paper expounds the research background and significance of the research, introduces the research situation of this topic at home and abroad, summarizes the research methods of the thesis, and analyzes the possible innovation points of the article, so as to lay the foundation for the full text writing. The second part: the theoretical basis of food safety ethics and legal regulation. Based on the concept of food safety, food safety ethics and law, this paper discusses the theoretical basis of food safety ethics and law, and provides a theoretical basis for future research. The third part: the present situation and cause analysis of the food safety problems in China. The present situation of food safety in China is expounded from the central and local levels, and the problems in every link of the food are analyzed. The fourth part: the Enlightenment of the food safety ethics and legal regulation of some developed countries to China. By analyzing the successful experience of some developed countries, such as the United States and Canada, in the process of controlling food safety, we can draw inspiration from reform and improvement of food safety ethics and legal regulation in China. The fifth part: measures to improve the ethical and legal regulation of food safety in China. Through the foundation of the above four chapters, it summarizes the ethical and legal regulation measures to alleviate the serious situation of food safety in China.
