【摘要】：机动车强制责任保险(以下简称“交强险”)是我国首个以法律规定实施的强制性责任保险。交强险对第三人范围作了规定,这对于维护受害第三人的人身安全、保障交通安全起到了一定的作用。但是,由于我国交强险起步较晚,道路交通安全法仅仅对交强险赔偿的处理原则作了规定,未对受害第三人范围作出明确的规定。相关的条例对交强险第三人规定又过于笼统,导致法官对机动车交通事故案件中交强险第三人的认定上存在一定的分歧:类似案件得到完全不同的裁判结果、同一案件的不同受害人之间得到的保险赔偿完全不一样。乘客、实际驾驶人等车上人员及上下车的乘客因各种原因脱离了本车,被本车碾压伤亡,其能否转化为第三人,获得交强险的相应赔偿,成为司法实务中争议的焦点。这些争议若得不到妥善的解决势必将影响司法的公正性、统一性与权威性。因此,如何界定交强险车上人员向第三人转化具有现实的紧迫性。文章通过真实案例来具体分析交强险中车上人员向“第三人”转化的问题,以求最大限度地解决交强险中车上人员向“第三人”转化中相关的理论与现实问题。文章将分四个部分对此问题进行探讨:第一部分,对四个实务案例的基本案情和法律审理情况进行简要的概述。第二部分,分析四个案例存在的争议点并分别对不同的观点进行了详细的阐述。第三部分,对交强险第三人基础法理进行分析,首先,对交强险第三人的含义与法理定位进行分析;其次,对车上人员向第三人转化的具体情形进行分析;最后,对转化为第三人的车上人员进行小结。第四部分,得出自己的研究结论,提出了对所选实务案例的看法,以期有助于厘清交强险中车上人员向第三人转化的界线。
[Abstract]:Compulsory liability insurance for motor vehicles (hereinafter referred to as "traffic insurance") is the first compulsory liability insurance implemented by law in China. Traffic insurance provides for the scope of the third party. This has played a certain role in maintaining the personal safety of the third injured person and ensuring the traffic safety. However, because of the late start of traffic force insurance in China. The road traffic safety law only provides the principle of compensation for traffic insurance, but not the scope of the injured third party. The relevant regulations on the third party in traffic insurance are too general. Leading to the judge in the motor vehicle traffic accident cases in the identification of the third person in traffic insurance there are certain differences: similar cases have completely different results. The insurance compensation received between the different victims of the same case was completely different. Passengers, actual drivers, and passengers on and off the vehicle had left the vehicle for various reasons and were crushed by the vehicle. Whether it can be transformed into a third party and get the corresponding compensation of traffic insurance becomes the focus of disputes in judicial practice. If these disputes are not properly resolved, it will inevitably affect the fairness, unity and authority of the judiciary. It is urgent to define how to transform the vehicle personnel into the third person. This paper analyzes the transformation of the vehicle personnel to the "third person" through real cases. In order to solve the related theoretical and practical problems in the transformation of the vehicle personnel to the "third party" in traffic insurance to the maximum extent, the article will be divided into four parts to discuss this problem: the first part. The basic facts of the four practical cases and legal proceedings are briefly summarized. The second part, the analysis of the four cases of controversy and the different points of view are described in detail. The third part. The author analyzes the basic legal principles of the third party in traffic insurance. Firstly, it analyzes the meaning and legal position of the third party in the traffic insurance. Secondly, it analyzes the specific situation of the transformation from the car personnel to the third person. At last, the summary of the third person on board. 4th part, draw their own research conclusions, and put forward the views of the selected practical cases. In order to help clarify the traffic insurance vehicle personnel to the third person transformation line.
