【摘要】：随着社会经济的迅猛发展,我国城镇化进入了快速推进时期,据数据显示,2014年城镇化率已达54.77%,可看出我国农村人口不断向城市迁移。在此过程中,呈现出重城市建设、忽略农村建设的特点,导致在农村开发建设活动中存在自发性和随意性,具体表现为:农村居民点、工业和集约化产业随意布局,基础设施落后,生活配套设施不足,景观环境和传统村落失去原有面貌。这些问题造成农村环境破坏,引发环境污染现象,严重影响了社会主义新农村建设“生产发展、生活宽裕、乡风文明、村容整洁、管理民主”的目标和要求的实现,也阻碍了我国农村乃至全国的可持续性发展。因此加强农村环境保护规划,预防环境破坏和污染成为当务之急。然而,我国目前的农村环境保护规划法律滞后,难以满足新农村建设的需要。本文在现有研究的基础上,着重从法律的角度探究我国出现农村环境保护规划问题的原因,并提出了一系列有针对性的对策建议。本文首先对新农村建设和环境保护规划及二者关系进行分析,阐明了环境保护规划对新农村建设的重要性;并由此作为出发点,通过对新农村环境保护规划现实问题和法律问题的剖析,揭示了导致环境污染和环境破坏的根源;进而,针对这种情况,以法律的视角分析农村出现环境保护规划问题的原因,诸如对立法、执法、环评联动及监管、法律规划意识四大方面进行了理性思考和挖掘;然后,分析国外优秀的环境保护规划经验对我国的可借鉴之处,最后,针对以上法律原因,借鉴优秀经验,提出了相应的完善我国农村环境保护规划的法律对策,以实现农村经济和环境的持续、健康、和谐的发展。
[Abstract]:With the rapid development of social economy, China's urbanization has entered a period of rapid progress. According to the data, the urbanization rate has reached 54.77% in 2014. It can be seen that the rural population in our country is constantly migrating to the city. In this process, the characteristics of urban construction are emphasized, and the characteristics of rural construction are ignored, which leads to the existence of spontaneity and arbitrariness in the activities of rural development and construction. The specific manifestations are: rural settlements, industrial and intensive industries randomly layout, backward infrastructure, inadequate living facilities, landscape environment and traditional villages lost their original appearance. These problems caused environmental damage in rural areas. The phenomenon of environmental pollution has seriously affected the realization of the objectives and requirements of the construction of new socialist countryside "production and development, rich life, civilization of local style, clean and tidy village, democratic management". It also hinders the sustainable development of rural areas and even the whole country. Therefore, it is urgent to strengthen rural environmental protection planning and prevent environmental damage and pollution. However, the current law of rural environmental protection planning in China lags behind. It is difficult to meet the needs of the new rural construction. Based on the existing research, this paper focuses on the legal perspective to explore the reasons for the problem of rural environmental protection planning in China. And put forward a series of targeted countermeasures and suggestions. Firstly, this paper analyzes the new rural construction and environmental protection planning and their relationship, and expounds the importance of environmental protection planning to the new rural construction. From this point of departure, through the analysis of the practical and legal problems of environmental protection planning in the new countryside, it reveals the causes of environmental pollution and environmental damage. Then, in view of this situation, this paper analyzes the causes of environmental protection planning problems in rural areas from the perspective of law, such as legislation, law enforcement, environmental impact assessment and supervision. The four aspects of legal planning consciousness are considered and excavated rationally. Then, the paper analyzes the foreign excellent environmental protection planning experience for our country, and finally, for the above legal reasons, learn from the excellent experience. In order to realize the sustainable, healthy and harmonious development of rural economy and environment, this paper puts forward the corresponding legal countermeasures to perfect the rural environmental protection planning in China.
