【摘要】：正【裁判要旨】过程性信息既可以是事实信息、意见信息,也可以附着于行为信息,作为行为信息的一部分而存在,故过程性信息并非当然不予公开。国务院办公厅《关于做好政府信息依申请公开工作的意见》不具有行政法律效力,其有关"过程性信息不予公开"之规定,不能作为司法审查的依据。不予公开过程性信息,只能依据《政府信息公开条例》第八条影响社会稳定不公开和第十四条第三款影响公平权益不公开的处断原则进行。公安机关在履行110接处警职责过程中形成的接处警记录和处理结果,分别属于处警行为的事实信息和附随于处警行为的行为信息,该两项信息与行政相对人的权益有重大影响,且公开也不会引发社会稳定问题或侵犯他人的合法权益,故依法均应予以公开。
