我国政府信息公开申请条件的缺陷与完善

【摘要】：政府信息公开申请条件是指公民在申请政府信息公开的过程中,申请人申请政府信息公开所必须要满足的各项要求,其对保障民众知情权、抑制腐败及建设服务型政府有着重要意义。目前,我国信息公开申请条件存在着申请原则的缺失、申请条件规定的不统一及对信息的过度收集等问题,这加大了申请的复杂程度,影响了公民行使知情权的热情。因此,应当完善立法对申请条件的规定,强化服务型政府理念,放宽申请条件,通过最高院指导性案例和民众行使知情权的推动,完善我国信息公开的申请条件。
[Abstract]:The government information disclosure condition refers to the citizens in the process of application for government information disclosure, the applicant to apply for government information disclosure must meet the requirements of the protection of the public right to know, is of great significance to curb corruption and build a service-oriented government. At present, China's information disclosure conditions there is a lack of application principle. The application conditions of the provisions are not unified and the problem of excessive collection of information, which increased the complexity of the application, the effect of the exercise of the right to know the enthusiasm of citizens. Therefore, we should perfect the legislation on the application conditions of the regulations, strengthen the concept of service-oriented government, relax the conditions for the exercise of the right to know the push by the Supreme Court of guiding cases and the people, improve the information disclosure of China's conditions.
