公安民警治安行政执法中的不作为问题研究

【摘要】：公安机关作为我国的治安行政管理机关,依法履行相应的行政管理职责。为维护社会治安秩序,保护国家利益、公共安全和公民的生命财产安全,公安民警依法运用国家赋予的权力和手段从事警务活动,职责重大,故民警执法权的行使也备受关注,近年来曝光的公安民警在治安行政执法中不作为现象,在社会造成了比较恶劣的影响。特别是在党的十八届四中全会将“深入推进依法行,加快建设法治政府”作为全面推进依法治国的六项重大任务之一背景下,依法行政日益受到重视。本文针对公安民警在治安行政执法中不作为现象展开分析,首先对这类不作为行为在法律上进行了定义;其次对其表现和危害进行了分析,并进一步剖析了这类不作为行为背后的成因；最后,针对这一问题,提出了健全法律法规、规范执法行为和加强执法监督三条建议,希望公安民警治安行政执法行为运行在更加规范的轨道上。
[Abstract]:The public security organs as the public security administrative organs of our country, to perform administrative duties accordingly in accordance with the law. In order to maintain public order, protect the interests of the state, public security and citizen's life and property safety, the police shall exercise the authority of the state and engaged in police activities, major responsibilities, the exercise of police enforcement has been right attention, in recent years the exposure of the police is not a phenomenon in the administrative law enforcement of public security, the impact of relatively poor in the society. Especially in the fourth Plenary Session of the 18th CPC Central Committee the party will further promote according to law, the six major task of speeding up the construction of the government under the rule of law "as the background of comprehensively promote the rule of law, administrative law has attracted more and more attention. According to the police in the public security administrative law enforcement is not as a phenomenon to analyze, first of all to this kind of act is defined in law; Secondly, analyzes the performance and harm, and further analyzes the causes of this kind of omission behind the behavior; finally, to solve this problem, put forward to perfect the laws and regulations, standardize law enforcement activities and strengthen the three recommendations of law enforcement supervision, hope the police of public security administrative law enforcement behavior operation in a more standardized track.
