劳动基准法中的惩罚性赔偿制度

【摘要】：惩罚性赔偿制度起源于英美法系,该制度一直是一项备受关注的制度,其不仅对英美法系国家产生了影响,甚至对大陆法系国家也产生了较大影响。同时,该制度也是我国民事立法与民法学研究较为热点的话题,它具有惩罚和遏制违法行为等民事法律制度不常有的功能。从我国目前的实际情况来看,在劳动争议纠纷案件日益增多的今天,侵害劳动者合法权益的行为层出不穷,劳动争议案件与一般的民事案件相比具有一定的特殊性,仅单纯地适用补偿性赔偿制度不足以遏制用人单位违反劳动基准法从而侵害劳动者合法权益的行为。因此,可以在劳动基准法领域中规定惩罚性赔偿制度,以达到减少用人单位违反劳动基准法行为的目的。
[Abstract]:The punitive compensation system originated in Anglo American law system, the system has been a concern of the system, which not only has an impact on the countries of Anglo American law system, and also had a great influence on the civil law countries. At the same time, the research of the system is also more hot topic of our civil legislation and civil law, it is to punish and deter illegal acts of civil law system, not common function. From the current situation, in the labor dispute cases is increasing today, emerge in an endless stream against the legitimate rights and interests of the behavior of workers, labor disputes and ordinary civil cases has certain particularity, only simply applies the compensatory damages system is not enough to contain to damage the legitimate rights and interests of the employer violates the Labor Standards Act. Therefore, can be specified in the labor standard law in the field of punitive compensation system, In order to reduce the purpose of reducing the behavior of the employer in violation of the labor standard law.
