【摘要】：摘要：随着我们这个社会变革和转型的加速,突发事件已经成为我们这个时代生活的一部分。应对突发事件不仅仅是对政府能力的考验,也是对法治的考验。在法治中国的进程中,实现非常状态下的法治,我们任重道远。如何更好的规制紧急状态下的行政紧急权力,是对我们法治完备程度的考量。本文以比例原则为主线,分析了行政紧急权力特点、对其进行规制的必要性,比例原则对其行使的具体要求。同时笔者也分析了域外的有关紧急权力的相关规定。最后笔者结合我国现有法律规定从比例原则的视角出发,提出对行政紧急权力进行规制的建议。文本除去引言和最后的结论共四部分,文章结构如下：第一部分分别阐释了突发事件和行政紧急权力的含义,分析了其特点,并对与行政紧急权力密切相关的概念——紧急状态进行了分析。第二部分介绍了有关比例原则的内涵,对《突发事件应对法》中的比例原则做了剖析,并根据行政紧急权力的特点,结合实例论证了对行政紧急权力进行规制的必要性。第三部分论证了在突发事件应对中比例原则对行政紧急权力的具体要求。第四部分笔者在前面分析论证的基础上提出了比例原则对行政紧急权力法律规制的运行与完善。
[Abstract]:Absrtact: with the acceleration of social change and transformation, unexpected events have become a part of our life in this era. Dealing with emergencies is not only a test of the government's ability. It is also a test of the rule of law. In the process of ruling by law in China, we have a long way to go to realize the rule of law in an extraordinary state. How to better regulate the administrative emergency power under the state of emergency. It is a measure of the completeness of our rule of law. Based on the principle of proportionality, this paper analyzes the characteristics of administrative emergency power and the necessity of regulating it. At the same time, the author also analyzes the relevant provisions of the extraterritorial emergency power. Finally, the author combines the existing legal provisions of our country from the perspective of the principle of proportionality. This paper puts forward some suggestions on the regulation of administrative emergency power. Apart from the introduction and the final conclusion, the text consists of four parts. The structure of the article is as follows: The first part explains the meaning of emergency and administrative emergency power, analyzes its characteristics, and analyzes the concept of emergency, which is closely related to administrative emergency power. The second part introduces the connotation of the principle of proportion, analyzes the principle of proportion in the Emergency response Law, and according to the characteristics of the administrative emergency power. The necessity of regulating the administrative emergency power is demonstrated by examples. The third part demonstrates the specific requirements of the principle of proportion in emergency response to administrative emergency power. On the basis of the above analysis and argumentation, the author puts forward the operation and perfection of the principle of proportionality to the legal regulation of the administrative emergency power.
