政府的环境责任问题研究

【摘要】：环境问题是人类迄今为止面临的最为严重的问题之一,1972年联合国人类环境会议上“环境保护”作为明确的概念被提出来。我国也在经过长期努力后,于1989年制订的《中华人民共和国环境保护法》(下文简称旧法),并在2014年4月24日通过了全面修改。新修订的《中华人民共和国环境保护法》(简称新法)修改幅度很大,其中对政府环境责任的规定更加详细。政府的环境责任完善是实现环境善治的一个重要环节,《环境保护法》修订案中有关政府环境责任的规定,既重视了政府在环境保护方面的积极职责,即积极履行服务、监督管理等;也强调了政府的消极责任,即没有履行环境职责的不利法律后果。是我国在环境法治中吸取的经验教训的总结,具有很强的针对性。本文主要基于对新《环境保护法》中对政府责任的规定进行政府的环境责任问题研究,通过中外法律的不同规定对政府的问责制度进行全面分析,并对政府环境责任的完善提出几点建议。
[Abstract]:Environmental problem is one of the most serious problems faced by mankind so far. In 1972, the United Nations Conference on the Human Environment was put forward as a clear concept of environmental protection. The Environmental Protection Law of the people's Republic of China (hereinafter referred to as the old law) enacted in 1989. In April 24th 2014, a comprehensive revision was adopted. The newly revised Environmental Protection Law of the people's Republic of China (abbreviated as the New Law) was amended by a very large margin. The perfection of government environmental responsibility is an important link to achieve good governance of the environment. It not only attaches importance to the positive responsibilities of the government in environmental protection, that is, to actively perform the service, supervision and management, and so on; It also emphasizes the negative responsibility of the government, that is, the adverse legal consequences of failing to perform environmental duties. It is a summary of the experience and lessons learned in the environmental rule of law in our country. This article is mainly based on the new "Environmental Protection Law" on the provisions of government responsibility for environmental responsibility of the government research. This paper makes a comprehensive analysis of the accountability system of the government through the different provisions of Chinese and foreign laws, and puts forward some suggestions for the perfection of the government's environmental responsibility.
