云南民用运输机场综合行政执法之实践研究

【摘要】：民用运输机场作为国家综合交通的重要组成部分,其运营安全是民航事业发展的重要前提和保障,关系到人民生命和国家财产的安全。由于体制机制变革,机场管理机构从政府机关、事业单位向企业法人转型,原有行政权力逐渐剥离,但由于民用运输机场的特殊性,作为企业法人的机场管理机构在实际管理中仍然具有部分行政权力。机场管理机构具有的行政权除机场公安局具有的标准行政权力外,其他行政权力并不明显,其法源也散布在各项法律和条例中,作为根本法源的《民航法》给予的授权并不明显。云南省现有民用运输机场12个,居全国第二位。2011年5月26日云南省第十一届人民代表大会常务委员会第二十三次会议审议通过《云南省民用运输机场保护条例》(以下简称“条例”),于2011年7月1日起施行。依据条例开展民用运输机场区域的综合行政执法工作,对于加强其对民用运输机场的保护,保障民用运输机场的安全和有序运营,加快实现“桥头堡”战略和“航空强省”目标,确保云南机场产业的又快又好发展,具有十分重要的现实意义。本文主要通过对机场管理机构所行使行政权力的法源、属性、内容、具体形式进行分析,结合云南民用运输机场及其他民用运输机场近年来行政权力行使的实际经验,对民用运输机场范围内形成的行政法律关系进行梳理并加以区分,对法律关系中主客体的特殊性进行归类,开展论述,寻找适合民用运输机场的行政权力行使方式。
[Abstract]:Civil transport airport as an important part of national comprehensive traffic, its operational safety is an important prerequisite and guarantee for the development of civil aviation, related to the lives of the people and the security of national property. Airport management institutions from government organs, institutions to corporate transformation, the original administrative power gradually stripped, but due to the particularity of civil transport airport. Airport administrative authority as an enterprise legal person still has some administrative power in actual management. The administrative power of airport management organization is not obvious except the standard administrative power of airport public security bureau. Its legal sources are also scattered in various laws and regulations, and the authorization given by the Civil Aviation Law, which is the source of this law, is not obvious. Yunnan Province has 12 civil transport airports. In May 26th 2011, the 23th session of the standing Committee of the 11th people's Congress of Yunnan Province deliberated and adopted the regulations on the Protection of Civil Transport Airports in Yunnan Province (. (hereinafter referred to as "the regulations"). As of July 1st 2011, comprehensive administrative enforcement of civil transport airport areas shall be carried out in accordance with the regulations, and the protection of civil transport airports shall be strengthened. It is of great practical significance to ensure the safe and orderly operation of the civil transportation airport, to accelerate the realization of the "bridgehead" strategy and the goal of "aviation strong province", and to ensure the rapid and sound development of Yunnan airport industry. This paper mainly analyzes the source, attribute, content and concrete form of the administrative power exercised by the airport management organization. Combined with Yunnan civil transport airport and other civil transport airport in recent years of practical experience in the exercise of administrative power, civil transport airport within the scope of the formation of administrative and legal relations are combed and differentiated. This paper classifies and discusses the particularity of subject and object in the legal relationship, and finds out the administrative power exercise mode suitable for civil transportation airport.
