云计算与信息安全法律的思考

【摘要】：信息安全是信息技术发展的必然要求，信息安全不仅仅是一个技术问题，还是一个法律问题。信息安全的法律需求随着信息技术的发展而变化，不同的技术时代有着不同的法律需求，从单机到局域网，再到广域网和互联网，，最后发展到今天的云计算。在云计算环境下，大量的数据存储在云服务器上，单一云服务商的漏洞就可能导致几百万用户的个人信息泄露。因为云计算环境的分布式特点，数据的访问、存储及传输可能会涉及到不同的司法管辖权；同时云计算分布式技术也会对计算机调查取证及证据保全链提出新的挑战。美国目前立法趋势主要是完善个人隐私在云计算环境下的保护以及国家安全和个人隐私之间的平衡。本文力图梳理信息技术的发展史来总结信息安全法律法规的发展及规律，并以美国的信息安全法律法规框架作为参照，同时结合云计算的技术特性，从而对我国云计算环境下信息安全立法工作提出建议。
[Abstract]:Information security is an inevitable requirement of the development of information technology. Information security is not only a technical issue, but also a legal issue. The legal requirements of information security change with the development of information technology. Different technological times have different legal needs, from single machine to LAN, then to WAN and Internet, and finally to cloud computing. In cloud computing environment, a large amount of data is stored on cloud servers. The single cloud service provider's vulnerability may lead to the disclosure of personal information of millions of users, because of the distributed characteristics of cloud computing environment, data access, storage and transmission may involve different jurisdictions; At the same time, cloud computing distributed technology will also pose a new challenge to computer investigation, forensics and evidence chain. The current legislative trend in the United States is to improve the protection of personal privacy in the cloud computing environment, as well as national security and personal privacy. This paper tries to comb the history of information technology to summarize the development of information security laws and regulations. With the reference of the information security laws and regulations of the United States and the technical characteristics of cloud computing, some suggestions on the legislation of information security in cloud computing environment in China are put forward.
