论精准扶贫的行政法规制

【摘要】:面对精准扶贫行政,习惯于采用"法解释学+行政行为"分析进路的行政法(学者)容易陷入以"事后总结者"或者"事前完美者"面目出现的"失语症"境地。鉴于精准扶贫主要是政府主导下的行政活动,以及此项行政活动的复杂性,可以运用融贯论所主张的方法来重新界定精准扶贫中的公共行政权力,从而为行政法规制精准扶贫行政提供新的切入点。这一新的视角可以抽象为"科际整合法+公共行政权力"分析进路。该分析进路主张行政法应当从来源要素、主体要素、运行要素、对象要素和物质保障要素等方面来规制精准扶贫行政,以便实现既有效制约精准扶贫中的公共行政权力,又保障精准扶贫任务得以完成的双重目标。
[Abstract]:In the face of precision poverty alleviation administration. Administrative Law which is used to the Analysis of "Administrative behavior of legal hermeneutics" (Scholar). It is easy to fall into the situation of aphasia as "summmer" or "perfect in advance". In view of the fact that accurate poverty alleviation is mainly an administrative activity under the leadership of the government. As well as the complexity of this administrative activity, we can use the method advocated by the theory of integration to redefine the power of public administration in the precision poverty alleviation. This new angle of view can be abstracted as the analysis way of "inter-branch integration law public administrative power", which advocates that administrative law should be based on the source elements. Subject elements, operational elements, object elements and material security elements to regulate precision poverty alleviation administration, in order to achieve the effective restriction of public administrative power in precision poverty alleviation. It also ensures that the task of precision poverty reduction can be achieved by the dual goal.
