对《档案法》修改草案时代背景的认识及修改建议

【摘要】：《中华人民共和国档案法修订草案(送审稿)》是档案立法环境、档案法律适用环境和档案执法环境发生巨大变化的产物。其中的立法宗旨建议修改为"为了规范档案的形成、管理和保护行为,保障公民利用档案的权利,促进国家和社会发展,根据宪法,制定本法"。法定档案范围中"应当归档保存的各种形式和载体的文件、记录和数据"建议修改为"已经归档和应当归档保存的各种形式和载体的文件、记录和数据"。"档案工作实现统一领导、分级管理的体制"建议修改为"档案工作实行统一领导,分级、分专业管理的体制"。档案工作原则中的"便于社会各方面利用为原则",建议修改为"便于社会各方面和公民利用为原则"。
[Abstract]:The revised draft of the Archives Law of the people's Republic of China (submitted for review) is the legislative environment for archives. The legal application environment of archives and the law enforcement environment of archives have undergone tremendous changes. The legislative purpose of the law is revised to "in order to regulate the formation, management and protection of archives, and to protect the rights of citizens to use archives." To promote the development of the state and society and to formulate, in accordance with the Constitution, the documents of various forms and carriers which shall be archived in the scope of the statutory archives of this Law. Records and data are proposed to be revised to "documents, records and data in various forms and carriers that have been archived and should be archived"... It is suggested that the system of classified management should be revised as "the system of unified leadership, grading and specialized management of archival work", and the principle of "facilitating the use of all aspects of society" in the principle of archival work. The proposal was revised as "the principle of facilitating the use of all aspects of society and citizens."
