论虚拟财产权的行政法保护

【摘要】：随着互联网产业在我国的高速发展，涉及虚拟财产的权利、义务关系已经成为社会和民众关注的焦点，相关侵权、违法案件也日益增多，但目前国家对虚拟财产权的法律保护仍处于空白地带。结合我国当前所处的社会发展时期和法律环境，行政法作为我国法律体系的重要组成部分，应在虚拟财产权保护问题上发挥重要作用，我国当前法律体系不够完善，，但政府的行政权却异常强大，强大的行政权可以有效地保障虚拟财产权，行政法保护体系的建立具有重要的理论与实践意义。本论文的研究方向属行政法范畴，论述其法律性质，法律保护的正当性和必要性，国内外对虚拟财产权保护的现状和存在的问题，提出完善虚拟财产权的行政法保护的具体措施。本文第一部分，拟界定主体域，先提出虚拟财产的概念，通过阐释其独特的特征，从其财产价值的属性出发，以案例实际等相关法律范畴的衍生，得出虚拟财产权的概念，然后对虚拟财产权的法律属性进行分析。本文第二部分，论述虚拟财产权行政法保护的必要性和正当性。从法理上和实际案例对行政法保护的法律作用、法律地位，保护的理念、原则进行分析，同时立足于我国实际法律环境，比较行政法相对于民法、刑法在权利的赋予、立法、执法、司法救济方面特有的优越性。本文第三部分，主要阐释韩国、美国、香港地区、台湾地区、法国、英国等关于虚拟财产权的行政法保护立法现状与实践，并进行评析。本文第四部分，对我国虚拟财产权的行政立法和司法保护现状和存的问题进行论述，将结合案例、法条、实务进行详细比较分析。同时提出完善虚拟财产权行政法保护的具体建议，主要从抽象行政行为和具体行政行为措施等范畴出发，包括完善立法、赋予职能、规范执法，加强行政监管等。
[Abstract]:With the rapid development of Internet industry in China, involving the rights of virtual property, the relationship between obligations has become the focus of attention of the society and the public, related infringement, illegal cases are also increasing. However, the legal protection of virtual property rights is still in the blank zone. Combined with the current social development period and legal environment in China, administrative law is an important part of our legal system. It should play an important role in the protection of virtual property rights. The current legal system of our country is not perfect, but the executive power of the government is very strong, and the powerful administrative power can effectively protect the virtual property rights. The establishment of administrative law protection system has important theoretical and practical significance. The research direction of this paper belongs to the category of administrative law, discusses its legal nature, the legitimacy and necessity of legal protection, the status quo and existing problems of the protection of virtual property rights at home and abroad. The concrete measures to improve the protection of virtual property rights in administrative law are put forward. The first part of this paper, to define the subject domain, first put forward the concept of virtual property, through the interpretation of its unique characteristics, from its property value attributes, with the case of the actual derivative of relevant legal categories. The concept of virtual property right is obtained, and then the legal attribute of virtual property right is analyzed. The second part of this paper discusses the necessity and legitimacy of the protection of virtual property rights in administrative law. It analyzes the legal function, legal status, concept and principle of the protection of administrative law from the point of view of legal theory and practical cases. At the same time, based on the actual legal environment of our country, compared with the civil law, criminal law in the empowerment of rights, legislation, law enforcement, judicial relief unique advantages. The third part of this paper mainly explains the current situation and practice of administrative law protection of virtual property rights in South Korea, the United States, Hong Kong, Taiwan, France, Britain and so on. This article 4th part, the administrative legislation and the judicial protection present situation and the existence question to our country virtual property right carries on the elaboration, will combine the case, the law article. At the same time, the author puts forward some specific suggestions to improve the protection of the administrative law of virtual property, mainly from the aspects of abstract administrative act and concrete administrative action measures, including perfecting legislation and endowing functions. Standardize law enforcement, strengthen administrative supervision and so on.
