供给侧改革下农村宅基地流转法律问题研究

【摘要】：在供给侧改革背景下,为给农村宅基地使用权流转提供理论参考,研究宅基地供给侧改革问题正当其时。在政府主导的框架下,立足于宅基地的稳定性和时代性两大特性,逐渐破除政府单一化供应主体局面,基于自愿的前提下,允许农民将符合一定条件的宅基地使用权对外流转,将农民宅基地使用权变现成为财产权益,提升宅基地配置利用效率。为确保重大改革要于法有据,基于社会保障角度,制定《农村宅基地管理法》,在以下3个方面展开分析:深化农村宅基地管理体系创新;坚守制定宅基地相关法律法规的四点原则;妥善解决与农民权益密切相关的社会保障问题。
[Abstract]:In the context of supply-side reform, in order to provide a theoretical reference for the transfer of the right to use the rural homestead, it is time to study the supply-side reform of the homestead. Based on the stability of the homestead and the characteristics of the times, gradually break down the government single supply of the main part of the situation, based on the voluntary premise, allow farmers to meet certain conditions of homestead use right to foreign circulation. In order to ensure that the major reform should be based on the law, based on the social security perspective, the "Rural Homestead Management Law" was formulated in order to realize the rights and interests of the peasants' homestead use right into property rights and improve the efficiency of the homestead allocation and utilization. The following three aspects are analyzed: deepening the innovation of rural homestead management system; Adhere to the four principles of making laws and regulations related to homestead; We will properly solve the social security problems closely related to the rights and interests of farmers.
