大庆市城市社区综合执法问题实证研究

【摘要】：城市社区是城区社会的最基层组织,建设和管理好社区是现代化城市发展的必然要求。近年来,我国一直在探索着各种城市社区管理的道路,在这个过程中涌现出铜陵模式、贵阳模式、鲁谷模式、上海模式等一批先进的、符合当地实际的社区治理道路。十八大三中全会《中共中央关于全面深化改革若干重大问题的决定》提出：“废止劳动教养制度,完善对违法犯罪行为的惩治和矫正法律,健全社区矫正制度”。社区矫正制度的建立,对社区管理特别是综合执法提出了更新、更高的要求,创新城市社区综合执法模式,已经成为当前政府体制改革和社会管理创新的迫切需要,这也成为了社区改革的时代背景。本文以大庆市城市社区综合执法改革为研究对象,首先对大庆市城市社区综合执法的宏观背景和现有模式进行了探索,对社区的法律地位、社区综合执法现状、贵阳等地在社区改革中的做法进行了总结,对现行社区执法模式的弊端进行了分析,并详细介绍了大庆市在创新工作架构、明确工作原则、设定工作模式、确定执行权限、规范流程等方面采取的具体改革措施。然后利用图标、数据、案例等资料认真分析了大庆现有综合执法模式在减少管理层级、整合执法力量、前移服务端口等方面取得的成效,从社区不具备行政执法主体资格、工作人员不具有执法人员资格、执法权限较少、执法力量不足、执法措施单一等五个方面对大庆市城市社区综合执法现存问题进行了实证解读。最后,针对大庆市城市社区综合执法中遇到的问题和困难,提出了自己的建议和思考：一方面要制定城市社区管理法、完善配套的法律法规、健全相关的地方性法规,实现现代国家治理模式转变与城市社区综合执法的规范发展；另一方面要通过争取国家特殊政策支持、建立城市社区综合执法机构、加强执法队伍建设等具体措施,大庆市城市社区综合执法的特色化发展。
[Abstract]:Urban community is the most basic organization of urban society, the construction and management of the community is the inevitable requirement of modern urban development. In recent years, our country has been exploring a variety of urban community management road. The establishment of community correction system, community management, especially comprehensive law enforcement has been updated, higher requirements. The innovation of urban community comprehensive law enforcement mode has become the urgent need of the current government system reform and social management innovation. This has also become the background of community reform. This paper takes Daqing city community comprehensive law enforcement reform as the research object, first of all, the macro background and existing mode of Daqing city community comprehensive law enforcement are explored. The legal status of the community, community comprehensive law enforcement status, Guiyang and other places in the practice of community reform were summarized, and the shortcomings of the current community law enforcement model were analyzed. And detailed introduction of Daqing City in the innovation work structure, clear working principles, set the work model, determine the implementation authority, standardize the process and other aspects of specific reform measures. Then use icons, data. Cases and other materials seriously analyzed Daqing existing comprehensive law enforcement model in reducing management levels, integration of law enforcement forces, forward service port and other aspects of the results, from the community does not have the qualification of administrative law enforcement. The staff does not have the qualification of law enforcement, law enforcement authority is less, law enforcement power is insufficient, law enforcement measures are single and other five aspects of Daqing city community comprehensive law enforcement existing problems were empirically interpreted. Finally. In view of the problems and difficulties encountered in the comprehensive law enforcement of urban communities in Daqing City, this paper puts forward its own suggestions and considerations: on the one hand, it is necessary to formulate the urban community management law, perfect the supporting laws and regulations, and improve the relevant local rules and regulations. To realize the transformation of modern national governance mode and the normative development of comprehensive law enforcement in urban communities; On the other hand, it is necessary to establish comprehensive law enforcement agencies in urban communities and strengthen the construction of law enforcement teams, so as to develop the comprehensive law enforcement of urban communities in Daqing City.
