我国企业工资集体协商制度存在的问题及完善研究

【摘要】:工资是与劳动者关系最为密切的问题,同时也是劳动关系的核心所在。在工资分配行为市场化和契约化特征日益明显的今天,工资集体协商制度已经成为提高劳动者报酬、化解劳资纠纷的最主要途径。2010年,我国开始实施以工资集体协商为核心内容的集体合同制度“彩虹计划”,工资集体协商在我国得到了极大的推行。然而,近几年也是我国劳资矛盾最激烈、集体劳动争议最频发的时期,工资集体协商在我国流于形式。 本文首先以我国企业工资集体协商制度的法律法规、协商层级和覆盖面为出发点详细地介绍了我国工资集体协商制度推行的现状、特点,而后详细地阐述了我国工资集体协商制度存在的主要问题有劳动力市场供大于求、劳资力量不对等、工会体制存在缺陷、政府定位不明、立法滞后等。最后,在借鉴国内外工资集体协商制度经验启示的基础上,提出了完善我国工资集体协商的建议:完善劳动力市场、改革工会体制、强化政府职能、构建完善的法律体系等。
[Abstract]:Wage is the most closely related issue with workers, but also the core of labor relations. In the wage distribution behavior marketization and contractual characteristics of today's increasingly obvious. Wage collective bargaining system has become the most important way to improve workers' remuneration and resolve labor disputes. 2010. China began to implement the collective contract system "Rainbow Plan" with collective wage negotiation as the core content, and the collective wage negotiation has been carried out greatly in our country. However, in recent years, it is also the most intense contradiction between labor and capital in our country. Collective labor disputes in the most frequent period, wage collective bargaining in China is a mere form. Firstly, this paper introduces the current situation and characteristics of wage collective bargaining system in China, starting from the laws and regulations of the collective wage negotiation system, the level of negotiation and the coverage of the system. Then elaborated in detail our country wage collective negotiation system existence main question has the labor market supply exceeds the demand, the labor force strength is not equal, the labor union system exists the flaw, the government position is unclear, the legislation lags behind and so on. On the basis of drawing lessons from the experience of wage collective negotiation system at home and abroad, this paper puts forward some suggestions to improve the wage collective negotiation in China: to perfect the labor market, to reform the trade union system, and to strengthen the functions of the government. Construct perfect legal system and so on.
