【摘要】：家庭农场作为现代化农业生产最具代表性的生产经营主体,它的发展直接影响着未来农业的发展方向。2013年中央一号文件提出要鼓励加快建设以家庭农场为代表的新型农业经营主体,以适应农业发展的需要,进一步提高农民的劳动生产率充分利用农村的土地资源。虽然各级政府已经开始积极探索家庭农场的发展模式,但在推行过程中还是存在诸多法律问题阻碍了家庭农场的发展。为此,本文在分析家庭农场法律内涵的基础上,通过总结我国家庭农场的发展现状,提出一个涉及家庭农场认定规则、组织形式、土地流转及融资担保等法律制度在内的多维完善机制,为我国家庭农场的稳步、健康发展提供可行的法律建议。本文的主要内容分为以下四个部分:第一部分:我国家庭农场的内涵界定与发展现状。目前无论是理论界还是实务界关于家庭农场的法律内涵仍存在很多争议,文章首先介绍了欧美国家关于家庭农场内涵的界定,其次阐述了有关我国家庭农场内涵的四种学说,通过分析各内涵的不足认为“新型农业经营主体说”更能代表家庭农场的法律内涵。最后,文章从实践模式及立法现状这两个方面考察和梳理了我国家庭农场的发展现状。第二部分:我国发展家庭农场的面临的现实困境。本章立足于我国家庭农场发展的制度建设问题,分析了目前家庭农场面临的认定规则、组织形式不统一的法律困境,同时,剖析了制约我国家庭农场发展的“瓶颈”因素——农地流入难和融资难问题。第三部分:我国家庭农场主体制度的立法改造。我国要培育以家庭农场为代表的新型农业经营主体,就必须立足于本国特色。文章首先在分析我国国情的基础上,结合理论界学者的研究成果,探讨了家庭农场必须满足的认定条件。其次,在明确家庭农场的法律地位的基础上,对各种组织形式的家庭农场进行分析,选择最有利于家庭农场发展的组织形式。第四部分:我国家庭农场发展难的立法回应。该章立足于家庭农场面临的农地流入难和融资难这两大难题,在第一节中提出从加快土地承包经营权确权颁证、完善土地承包经营权“两权分离”制度、规范土地承包经营权的流转程序、构建家庭农场土地退出制度等方面入手,为家庭农场解决农地流入难问题提供帮助。第二节主要从健全家庭农场土地经营权抵押担保制度和完善土地经营权抵配套制度,这两个方面着手,提出解决家庭农场融资难的思路。
[Abstract]:Family farm as the most representative production and management of modern agricultural production. Its development directly affects the future development direction of agriculture. In 2013, the No. 1 document of the Central Committee proposed to encourage the construction of a new type of agricultural management, represented by family farms, in order to meet the needs of agricultural development. Further improve the labor productivity of farmers to make full use of rural land resources, although governments at all levels have begun to actively explore the development model of family farms. However, there are still many legal problems that hinder the development of family farm. Therefore, based on the analysis of the legal connotation of family farm, this paper summarizes the current situation of family farm development in China. Put forward a multi-dimensional perfect mechanism which involves the family farm identification rule, organization form, land circulation and financing guarantee and so on, which is steady for the family farm of our country. The main content of this paper is divided into the following four parts: the first part:. At present, there are still many controversies about the legal connotation of family farm in both theoretical and practical circles. The article first introduces the definition of the connotation of family farm in Europe and the United States, and then expounds four theories about the connotation of family farm in China. Through the analysis of the shortcomings of the connotation that "new agricultural management subject" can represent the legal connotation of the family farm. Finally. The article examines and combs the present situation of family farm development in China from the two aspects of practice mode and legislative status. The second part:. This chapter is based on the system construction of family farm development in China. At the same time, it analyzes the legal dilemma that the family farm is faced with the identification rules and the disunity of the organization form at the same time. This paper analyzes the "bottleneck" factors that restrict the development of family farms in China-the difficulties of farmland inflow and financing. Part three:. The legislative reform of the main body system of family farm in China. China should cultivate a new type of agricultural management subject represented by family farm. First of all, based on the analysis of the national conditions of our country, combined with the research results of theoretical scholars, this paper discusses the identification conditions that family farms must meet. Secondly. On the basis of clarifying the legal status of the family farm, this paper analyzes the family farm of various forms of organization. Choose the most conducive to the development of family farm organization form. 4th part: the legislative response to the difficulties of family farm development. This chapter is based on the family farm facing the difficulty of farmland inflow and financing difficulties. In the first section, the author puts forward to speed up the certification of the right of land contracting management, perfect the system of "separation of two rights" of the right of land contract management, and standardize the procedure of circulation of the right of land contract management. The second section mainly from the improvement of the family farm land management right mortgage system and improve the system of supporting land management rights, these two aspects. The paper puts forward some ideas to solve the problem of family farm financing.
