“二孩政策”下保护女性就业权立法完善研究

【摘要】：全面"二孩政策"在我国已经落地,这可能使得女性的生育时间、生育成本比原来增加一倍,预示着女性在社会公共岗位上的工作时间缩短、经济负担增大。如果女性参与社会劳动时间缩短,可能导致其社会、家庭地位的下降。"二孩政策"的出台不应当冲击两性平等的基本规则,包括两性就业权的平等。如何在"二孩政策"背景下保护女性就业权成为立法必须做出回应的问题。依据立法现状与"就业歧视"现实的拷问,保护女性就业权立法层面存在立法理念待矫正、立法内容过时须修正和完善等问题。分析问题产生的原因,应从立法理念、立法原则、立法规则层面提出保护女性就业权立法的建议。
[Abstract]:The comprehensive "two-child policy" has already fallen to the ground in China, which may make women's birth time, birth cost more than double than before, foreshadowing a shorter working time for women in social public posts. If women's participation in society is shortened, it may lead to a decline in their social and family status. The introduction of the "two-child policy" should not impinge on the basic rules of gender equality. Including the equality of the right to employment of both sexes. How to protect women's right to employment under the background of "two-child policy" has become a problem that the legislation must respond to. According to the current situation of legislation and the reality of "employment discrimination" torture. There are some problems in the legislative aspect of protecting women's right to employment, such as the legislative idea to be corrected, the legislative content to be revised and perfected when the legislative content is too late, and so on. The analysis of the causes of the problems should be based on the legislative idea and the legislative principles. At the level of legislative rules, the author puts forward some suggestions on legislation to protect women's right to employment.
