论行政教示行为的司法救济

【摘要】:摘要:随着我国法治进程的不断加快和服务型政府建设的发展,行政教示制度也得到了快速的发展和完善,让行政相对人与行政主体能更好地互动,更好地维护自身的合法权益。但是,教示制度飞速发展的同时,各种违法现象也是层出不穷,而与之相对应的救济制度尤其是司法救济制度却并没有得到应有的重视,使行政相对人的合法权益无法得到有效保障。 传统行政法理论认为行政教示行为是附属于实体行政行为的程序性行为,不能对行政相对人的实体权益产生实际影响,因此其不具有可诉性;在审理上,法院如认为实施行政行为的程序违法,应作出撤销该具体行政行为的判决,判决方式单一。随着对程序性行政行为研究的深入,行政教示行为在一定程度上也具有侵权性和独立性,对于其是否具有可诉性不能一概而论,具有侵权性和独立性的违法行政教示行为应该纳入行政诉讼受案范围,而且对于违法行政教示行为的判决应该多样化,对于侵犯行政相对人合法权益的行政教示行为可以采用撤销判决,而对于没有侵犯行政相对人合法实体权益的违法行为,不能一概采用撤销判决,可以采用确认违法等多种更优的判决形式。
[Abstract]:Absrtact: with the continuous acceleration of the process of rule of law and the development of service-oriented government construction, the system of administrative instruction has also been rapidly developed and perfected, so that the administrative counterpart and the administrative subject can interact better. Better safeguard their legitimate rights and interests. However, with the rapid development of the teaching and demonstration system, various illegal phenomena also emerge in endlessly, but the corresponding relief system, especially the judicial relief system, has not received due attention. The legitimate rights and interests of the administrative counterpart can not be effectively protected. The traditional administrative law theory holds that the administrative teaching act is a procedural act attached to the substantive administrative act, which can not have a practical impact on the substantive rights and interests of the administrative counterpart, so it is not actionable. If the court considers that the procedure for the execution of an administrative act is illegal, it shall make a judgment to revoke the specific administrative act, and the judgment shall be in a single way. With the deepening of the study of the procedural administrative act, To a certain extent, the administrative teaching behavior also has the nature of tort and independence. Whether it is actionable or not can not be generalized, and the illegal administrative teaching act with tort and independence should be included in the scope of administrative litigation cases. Moreover, the judgment of illegal administrative teaching behavior should be diversified. For administrative teaching act that infringes the legitimate rights and interests of the administrative counterpart, the decision can be revoked, but for the illegal act that does not infringe the legal entity rights and interests of the administrative counterpart, We can't always adopt annulment judgment, we can adopt more superior judgment form, such as confirmation of violation of law and so on.
