绿色技术发展的立法回应:问题与破解

【摘要】：绿色发展的关键在于绿色技术的支撑和法律制度的保障。为有效因应和解决绿色技术发展中面临的种种问题,立法必须作出相应的制度安排。由于绿色技术的发展日新月异,因此相应的立法规定必须及时;同时由于绿色技术立法的难度高于通常性的立法,因此绿色技术立法在满足"既快"的条件下还必须符合"又好"的质量要求,以及立法过程的民主性要求。当前,我国绿色技术立法既要解决立法迟滞的问题,又要探寻提升立法质量的举措和途径,尤其应处理好绿色技术立法的科技一般性与其独特的绿色公益性、技术性与规范性、科学性与民主性之间的关系,应着力消除绿色技术立法的碎片化与冲突问题,从而通过构建迅捷而高质、科学有效和统一协调的立法体系,来实现绿色技术发展的"良法善治"。
[Abstract]:The key to green development lies in the support of green technology and the guarantee of legal system. In order to effectively respond to and solve all kinds of problems in the development of green technology, legislation must make corresponding institutional arrangements. Therefore, the corresponding legislative provisions must be timely; at the same time, because the green technology legislation is more difficult than the usual legislation, the green technology legislation must meet the quality requirements of "both fast" and "good". And the democratic requirements of the legislative process. At present, China's green technology legislation should not only solve the problem of lagging legislation, but also explore measures and ways to improve the quality of legislation. In particular, the relationship between the generality of green technology legislation and its unique green public welfare, technology and standardization, science and democracy, and the fragmentation and conflict of green technology legislation should be eliminated. Thus, the "good law and good governance" of the development of green technology can be realized through the construction of a rapid and high quality, scientific, effective and unified and coordinated legislative system.
