温州市基层公安执法规范化研究

【摘要】：公安是我国政府机构的重要组成部分,我国相应的法律、法规规定了其担负的职责,享有的职权以及行使职权的程序。近年来,社会上对公安执法规范化有了广泛的关注,而在温州,市民对执法规范化的态度更为明显,就是认为公安执法规范化是法治社会最重要的一部分,基层公安要牢牢把握法治这个根本,做到执法规范化。笔者对温州市公安执法规范化建设研究进行了论述。本文采取论述,发现问题,解决问题的线索展开,共分为六个部分。第一部分介绍了选题的目的和意义,国内外研究现状及本文的创新点等。第二部分是公安执法规范化的相关概念和相关理论,是全文的基础和展开讨论的前提,这部分结合我国相关的法律、法规的规定,比较外国相关理论,论述了公安执法规范化的概念、特征,为下文展开铺垫。第三部分着重分析基层公安执法规范化的必要性。第四部分是温州市基层公安执法规范化的现状、困境和成因,主要讲温州基层公安执法规范化的背景和近年来取得的成效;随后针对问题分析了温州基层公安执法规范化的困境及成因,是本文的难点,结合温州的案例以及调查数据,从深层次了解温州市基层公安执法规范化建设遇到的障碍。第五部分分析了国内外优秀的管理经验,引用借鉴。第六部分是提出温州市基层公安执法规范化的对策,是本文的重点,就上文提出的问题和难点提出相应的对策,论述了如何推进公安执法规范化的建设。温州市基层公安执法规范化研究,对温州市公安机关管理体制改革和完善具有较大的理论和现实意义。
[Abstract]:The public security is an important part of the government organization in our country. The corresponding laws and regulations of our country stipulate the duty, the authority and the procedure of exercising the power. In recent years, the society has paid extensive attention to the standardization of the law enforcement of the public security. But in Wenzhou, the attitude of citizens towards the standardization of law enforcement is even more obvious, that is, they think that the standardization of law enforcement by public security is the most important part of a society governed by law. The author discusses the research on the standardization of law enforcement in Wenzhou City. This paper discusses, discovers the problem, develops the clue of solving the problem, and divides it into six parts. The first part introduces the purpose and significance of the topic. The second part is related concepts and related theories of the standardization of public security law enforcement, which is the basis of the full text and the premise of the discussion. This part combines the relevant laws and regulations of our country. Comparing the relevant theories of foreign countries, this paper discusses the concept and characteristics of the standardization of public security law enforcement, which lays the groundwork for the following. The third part focuses on the analysis of the necessity of the standardization of the law enforcement at the grass-roots level. Part 4th is the present situation of the standardization of the enforcement of the law at the grass-roots level in Wenzhou City. Difficulties and causes, mainly on the background of Wenzhou grass-roots police law enforcement standardization and the results achieved in recent years, followed by an analysis of the difficulties and causes of Wenzhou grass-roots public security law enforcement standardization, is the difficulty of this article. Based on the case of Wenzhou and the investigation data, the author has a deep understanding of the obstacles encountered in the standardization of public security enforcement at the grass-roots level in Wenzhou. Part 5th analyzes the excellent management experience at home and abroad. The reference of 6th is to put forward the countermeasures to standardize the law enforcement of public security at the grass-roots level in Wenzhou, which is the focus of this paper, and to put forward the corresponding countermeasures to the problems and difficulties raised above. This paper discusses how to promote the construction of the standardization of public security law enforcement. The research on the standardization of public security law enforcement at the grass-roots level in Wenzhou has great theoretical and practical significance for the reform and improvement of the management system of public security organs in Wenzhou.
