我国高等教育垄断问题的法律规制

【摘要】：改革开放以来，我国高等教育迅猛发展。高等教育的快速发展回应了人们一直以来对高等教育的期盼。在高速发展的同时我们应当清醒看到，高等教育中的垄断问题与发展如影相随，并且有愈演愈烈之势，严重阻碍了我国高等教育向前发展和高等教育质量的提升，是高等教育发展所形成的毒瘤，不破除则直接制约我国高等教育的发展与质量的提升。高等教育中垄断主要是两种形式，，一是市场垄断，二是行政垄断。行政垄断对高等教育影响尤为强烈。高等教育垄断是教育行政部门行为与高等院校行为的结合，具有行政性垄断与经济性垄断的复杂性。要打破高等教育垄断现象，规范高等教育市场秩序，必须要进行法律规制。对于合法的高等教育垄断要予以保护。如对某些高等教育垄断行为是有利于国家安全利益、社会稳定和高等教育发展，又不影响高等教育正常竞争秩序的；同时市场也有失灵的一方面，使得高等教育市场不能脱离政府的宏观管理，而且政府的文化职能决定了它要对高等教育活动进行必要的调控。对于不合法的高等教育垄断必须依法规制。一是要重新审查高等教育法律法规与制度，二是要完善高等教育法，三是高等教育行政垄断适应《反垄断法》，四是重新界定高等教育行政权，五是在高等教育领域推行教育券。
[Abstract]:Since the reform and opening up, China's higher education has developed rapidly. The rapid development of higher education has responded to people's expectations for higher education. The monopoly problem in higher education is accompanied by its development, and it is becoming more and more intense, which seriously hinders the development of higher education and the improvement of higher education quality in our country. It is a cancer formed by the development of higher education. The monopoly in higher education consists of two forms, one is market monopoly, the other is administrative monopoly, which has a strong influence on higher education. The monopoly of higher education is the combination of the behavior of the administrative department of education and the behavior of higher education, and has the complexity of administrative monopoly and economic monopoly. It is necessary to break the phenomenon of monopoly in higher education and standardize the order of higher education market. Must carry on the legal regulation. The legal monopoly of higher education should be protected. For example, some monopolistic behaviors of higher education are beneficial to the national security interests, social stability and the development of higher education, and do not affect the normal competitive order of higher education. At the same time, there is a failure of the market, which makes the higher education market can not be divorced from the macro management of the government, and the cultural function of the government determines that it must regulate and control the activities of higher education. The illegal monopoly of higher education must be regulated in accordance with the law. The first is to review the laws, regulations and systems of higher education, and the other is to improve the higher education law. Third, the administrative monopoly of higher education adapts to the Anti-monopoly Law, the fourth is to redefine the executive power of higher education, and the fifth is to implement educational vouchers in the field of higher education.
