劳动法学中的劳资伦理内涵研究

【摘要】:在对劳资关系性质和劳动法认识不断深化的过程中,劳资伦理学术命题逐渐成为劳动法学界研究的理论前沿和热点问题,其内涵研究则属于基础性的工作。伦理是人与人之间关系的应然之理,从劳资关系的性质看,劳资关系身份主体具有伦理性,劳资关系缔结与存续具有伦理性,劳资关系主体行为互动具有伦理性。以定义方式界定劳资伦理内涵,它是指特定社会历史条件下,由于缔结劳资关系而具有劳资身份的主体形成的应然性劳资关系所内含的规范性要求。 劳资伦理具有社会经济条件决定性,是由经济基础条件、政策法律条件和劳资关系现实条件等因素共同决定的;劳资伦理的实然性与应然性和内在性与外在性相统一,以劳资关系的客观存在为前提并指向其应然状态,内含规范性要求并指导劳资关系实践;劳资伦理的内容包含对劳动者的伦理要求和对用人单位的伦理要求两个方面。在劳动合同阶段,劳动者应尊重用人单位用工自主权、与用人单位诚信立约;用人单位则应尊重劳动者劳动力市场主体地位、与劳动者诚信立约。在劳动履行阶段,劳动者应以用人单位之劳动者的身份劳动、按契约或资方管理履行劳动、对用人单位忠实;用人单位则应对劳动者信守劳动契约、以劳动者之用人单位的伦理身份关爱劳动者、维护劳资秩序并营造伦理氛围。 劳资伦理及其内涵为劳动法学研究提供了新视角和新思路,可作为调处劳资关系问题的伦理指导,为劳动法制提供伦理支撑并促进劳动法治的完善,对深入研究劳资关系和劳动法学具有重要意义。
[Abstract]:In the process of deepening the understanding of the nature of labor relations and labor law, the academic proposition of labor ethics has gradually become the theoretical frontier and hot issue in the field of labor law. The study of its connotation belongs to the basic work. Ethics is the principle of the relationship between people. Judging from the nature of labor relations, the identity subject of labor relations is ethical, and the conclusion and existence of labor relations is ethical. The interactivity of the subject of labor relations is ethical. It defines the connotation of labor ethics by definition, which refers to the specific social and historical conditions. Due to the conclusion of labor relations, the subject with the status of labor should form the normative requirements contained in the labor relations. Labor ethics has the decisive social and economic conditions, which are determined by the economic base, policy and law, and the realistic conditions of labor relations. Taking the objective existence of labor relations as the premise and pointing to its supposed state, it contains normative requirements and guides the practice of labor relations; The content of labor ethics includes two aspects: the ethical requirement for laborer and the ethical requirement for employer. In the stage of labor contract, the laborer should respect the employer's autonomy and make an agreement with the employer in good faith. The employer shall respect the principal position of the laborer in the labor market and enter into a contract with the laborer in good faith. In the stage of labor performance, the laborer shall work as the laborer of the employer and perform his work in accordance with the contract or management of the employer, The unit of choose and employ persons should abide by the labor contract, care the laborer with its ethical identity, maintain the order of labor and create an ethical atmosphere. Labor ethics and its connotation provide a new angle of view and a new way of thinking for the study of labor law, which can be used as the ethical guidance to deal with the problems of labor relations, to provide ethical support for the labor law system and to promote the perfection of labor rule by law. It is of great significance to further study labor relations and labor law.
