我国竞技体育中反兴奋剂法律研究

【摘要】：公平竞争是竞技体育最基本的条件,但在今天的国际体坛,兴奋剂违规现象却屡禁不止。为了遏制反兴奋剂使用的现象,保障体育赛场上的公平性,维护运动员身心健康,我国先后颁布了《反兴奋剂条例》《反兴奋剂管理办法》等规章制度来应对这种现象。目前我国反兴奋剂制度还存在一些问题,在兴奋剂违规制度的法律体系、管理机构责任划分、兴奋剂检测程序、兴奋剂违规处罚标准、违规者救济程序等方面存在漏洞甚至是空白。这是我国反兴奋剂工作中不容忽视、亟待解决的问题。我国反兴奋剂立法在一定程度上与实际工作还不够匹配,部分规定在实践中已无法适应反兴奋剂工作的需要。本研究通过文献资料法、比较研究法和内容分析法,找到我国反兴奋剂制度的不足之处,借鉴国外反兴奋剂制度经验,为完善我国反兴奋剂制度提出一些参考意见。本研究认为,要解决我国竞技体育中反兴奋剂问题,要从以下几个方面进行:第一,完善我国竞技体育中反兴奋剂的法律体系;第二,要理清我国竞技体育中反兴奋剂管理机构之间的责任;第三,要增加我国竞技体育中反兴奋剂检测程序的透明度;第四,要统一我国竞技体育中兴奋剂违规处罚标准;第五,要增强我国竞技体育中兴奋剂违规者救济程序的实用性。
[Abstract]:Fair competition is the most basic condition of competitive sports, but in today's world of sports, doping violations are not prohibited. In order to curb the phenomenon of anti-doping use, to ensure fairness in sports venues, and to safeguard athletes' physical and mental health, China has successively promulgated the "Anti-Doping regulations" and "Anti-Doping Control measures" to deal with this phenomenon. At present, there are still some problems in the anti-doping system in our country. There are loopholes or even gaps in the division of responsibilities of the administrative bodies, the procedures for the detection of stimulants, the standards of punishment for doping violations, the procedures for remedy of violators, etc. This is an issue that can not be ignored in the work of anti-doping in our country. China's anti-doping legislation to some extent does not match the actual work, some of the provisions in practice can no longer meet the needs of anti-doping work. The comparative research method and the content analysis method, find out the deficiency of the anti-doping system of our country, draw lessons from the experience of the foreign anti-doping system, put forward some reference opinions for perfecting the anti-doping system of our country. In order to solve the problem of anti-doping in competitive sports of our country, we should carry out the following aspects: first, perfect the legal system of anti-doping in competitive sports of our country; Third, it is necessary to increase the transparency of anti-doping detection procedures in competitive sports in China; 4th, to unify the standards of punishment for doping violations in competitive sports in China; and 5th, to enhance the practicability of relief procedures for doping violators in competitive sports in China.
