休息权实现机制的形式特征与内在动因——兼论我国休息休假制度的理论重构

【摘要】：休息休假制度的任务在于保障休息权的实现。休息权的实现依赖于一定的作用机制。机制受阻便造成了可利用的自由时间减少,休息休假制度即陷入困境。破解制度的困境、恢复制度的活力,着力点在于使制度符合休息权实现机制的内在要求。休息权实现机制并非仅由成文的制度规范构成,它还包括人们在借助制度规范行为过程中所形成的非制度性规范。它的形式特征在于休息权的实现途径在制度规范与权利参与者之间形成相互作用、相互影响的双向作用机制,不断寻求稳定与平衡。而它的内在动因则来自于国家制定法与社会自生秩序之间张力,这股张力产生于不同利益主体为了实现自身利益而在劳动时间分配问题上所进行的博弈。
[Abstract]:The task of the rest and leave system is to guarantee the realization of the right to rest. The realization of the right to rest depends on a certain mechanism. The key point of restoring the vitality of the system is to make the system conform to the inherent requirements of the realization mechanism of the right to rest, which is not only constituted by the written norms of the system. It also includes the non-institutional norms formed by people in the process of using institutional norms. Its formal characteristics lie in the two-way mechanism of interaction and interaction between institutional norms and rights participants through the means of realizing the right to rest. The internal motivation comes from the tension between the state law and the social order, which comes from the game between different interest subjects in the distribution of labor time in order to realize their own interests.
