未成年犯的刑事处罚方法研究

【摘要】：近年来,我国未成年人犯罪案件数目居高不下,俨然成为了一个严重的社会问题。未成年人作为社会上的一类特殊群体,他们能否健康成长不仅关系着许多家庭的幸福,同时也严重影响社会发展的稳定,因此未成年人犯罪问题受到了社会各界人士的广泛关注。伴随着我国未成年人犯罪案件的增长幅度日益增大,国家也正在不断加大对未成年人的保护力度。随着法律制度的发展,对未成年人的权益保护方面的法律法规也逐渐增加,除了最基本的《刑法》外,《未成年人保护法》、《预防未成年人犯罪法》、《治安管理处罚法》以及《最高人民法院关于审理未成年人刑事案件具体应用法律若干问题的解释》等都对未成年人问题作了相应的规定。但是,我国未成年人法律制度仍然处于发展的初级阶段,立法体系还不够完善,法律规定都比较零散,尚未形成统一的未成年人法律保护体系,关于未成年人犯罪的刑罚适用问题仍然存在缺陷,需要不断完善,笔者认为应当结合我国未成年人犯罪的特别原因,相应调整这类群体的刑罚适用体系。因此,本文主要从立法、法律实践等方面对比国外的法律经验来分析我国目前对未成年犯刑事处罚方面存在的不足之处,并针对如何完善未成年犯的刑罚适用方面的法律及相关非刑罚措施,提出改进的方法和意见。论文的第一部分简要介绍未成年人犯罪的相关概念以及我国未成年的犯罪现状,并对其原因进行深层次剖析。第二部分主要针对国内外有关未成年人犯罪刑罚方面的立法概括来分析我国的立法模式。第三部分则具体探讨我国未成年人犯罪的刑罚方式适用问题,包括主刑及各种附加刑。最后一部分笔者主要针对社区矫正等非刑罚处置作为对未成年人犯罪刑事处罚改革的补充方面进行探析,并提出完善的建议。
[Abstract]:In recent years, the high number of juvenile delinquency cases in China has become a serious social problem. As a special group in society, whether or not minors can grow healthily is not only related to the happiness of many families. At the same time, it also seriously affects the stability of social development. Therefore, the problem of juvenile delinquency has been widely concerned by people from all walks of life. With the increasing range of juvenile delinquency cases in our country, The state is also continuously increasing the protection of minors. With the development of the legal system, laws and regulations on the protection of the rights and interests of minors are also gradually increasing. In addition to the most basic Criminal Law, the Law on the Protection of minors, the Law on the Prevention of Juvenile Delinquency, the Law on the punishment of Public Security Administration, and the Supreme people's Court on the specific Application of Law in handling Criminal cases of minors. Explanation > and so on have made the corresponding stipulation to the minor problem. However, The legal system of minors in our country is still in the primary stage of development, the legislative system is not perfect enough, the legal provisions are scattered, and a unified legal protection system for minors has not yet been formed. There are still defects in the application of the penalty for juvenile delinquency, which need to be improved constantly. The author thinks that we should adjust the applicable system of penalty for this kind of group according to the special reasons of juvenile delinquency in our country. This article mainly from the legislation, the legal practice and so on aspect contrasts the foreign legal experience to analyze our country at present to the juvenile criminal punishment aspect existence insufficiency, In the light of how to perfect the applicable law and related non-penalty measures of juvenile delinquents, this paper puts forward some improved methods and suggestions. The first part of the paper briefly introduces the related concepts of juvenile delinquency and the current situation of juvenile delinquency in China. The second part mainly aims at the domestic and foreign related minor crime penalty aspect legislation summary to analyze our country legislation pattern. The third part is the concrete discussion our country minor crime. The application of penalties, The last part is mainly aimed at community correction and other non-penal treatment as a supplementary to the reform of criminal punishment for juvenile delinquency, and put forward some suggestions.
