我国环境保护中的区域限批制度研究

【摘要】：当前,环境问题越来越严重,环境治理刻不容缓。环境问题的解决既需要社会公众提高环保意识,保护环境,积极配合环境治理工作,更需要人民政府转变发展思路,创新发展模式,加强环境治理,担负起环境责任。新《环境保护法》的颁布实施就是为了更好的解决环境问题。“区域限批制度”作为新环保法确立的环保制度之一,对强化地方各级政府环保意识,落实环保责任有着十分重要的意义。它通过对某一区域建设项目暂停审批的措施,来督促当地政府履行环境责任,加强环境治理,取得的实效也十分明显。但同时我们也要客观分析这一制度存在的问题,如果区域限批制度的问题不能得到很好的解决,必将会对这一制度的实施产生影响。具体而言,本文主要包括引言、正文、结论三部分,主要内容如下:第一章是引言部分。介绍了区域限批制度的研究背景、目的、国内外研究现状以及研究内容与方法;第二章是区域限批制度的概述,本章大致分为四部分,首先介绍了区域限批的含义,确定了本文的研究范围;其次介绍了区域限批制度的缘起,阐述了区域限批制度的发展历程,了解了不同历史时期区域限批制度的特点和发挥的作用。再次是对区域限批制度的意义进行总结归纳,进一步明确了区域限批制度在我国环境保护体系中发挥的重要作用以及研究区域限批制度的重要意义。最后是对与区域限批制度相关的制度进行介绍。理清了相关环保制度与区域限批制度的关系,确定了区域限批的制度基础;第三章是对区域限批运行模式的分析。因为区域限批中存在着较多的行政主体,各主体之间的关系较为复杂,了解了区域限批制度中各行政主体之间的运行模式就能理清各个主体之间的关系;第四章主要是对区域限批制度的法律渊源和内容的分析。将有关区域限批制度的法律法规进行汇总,通过对相关法律的分析,总结区域限批制度的主要内容,具体包括:情形、主体和程序;第五章是找出区域限批制度存在的问题;第六章根据发现的问题,给出了一定的法律建议,以期使区域限批制度更为完善,发挥其应有的作用。
[Abstract]:At present, environmental problems are becoming more and more serious, and environmental management is urgent. The solution of environmental problems requires the public to raise their awareness of environmental protection, to protect the environment, to actively cooperate with the work of environmental governance, and to change the development mentality of the people's governments. Innovating the development mode, strengthening the environmental management, shouldering the environmental responsibility. The promulgation and implementation of the new Environmental Protection Law is to solve the environmental problems better. As one of the environmental protection systems established by the new environmental protection law, the "regional restriction approval system" is one of the environmental protection systems established by the new environmental protection law. It is of great significance to strengthen the environmental protection awareness of local governments at all levels and to implement environmental protection responsibilities. It urges local governments to fulfill their environmental responsibilities and strengthen environmental governance by suspending the approval of certain regional construction projects. But at the same time, we also need to objectively analyze the problems existing in this system. If the problems of the regional restriction system are not solved very well, it will certainly have an impact on the implementation of this system. The main contents of this paper are as follows: the first chapter is the introduction part. It introduces the research background, purpose, domestic and foreign research status, research content and methods of the regional limited batch system; The second chapter is an overview of the regional limited approval system. This chapter is divided into four parts. Firstly, it introduces the meaning of regional limited approval, determines the scope of this study; secondly, it introduces the origin of the regional limited approval system. This paper expounds the development course of the regional restricted approval system, understands the characteristics and functions of the regional limited approval system in different historical periods, and summarizes the significance of the regional limited approval system. This paper further clarifies the important role of the regional limited approval system in the environmental protection system of our country and the significance of studying the regional limited approval system. Finally, it introduces the system related to the regional limited approval system and clarifies the phase. The relationship between environmental protection system and regional restriction system, The third chapter is the analysis of the operation mode of regional limited approval, because there are more administrative subjects in the regional limited approval, and the relationship between them is more complex. Understanding the operation mode of each administrative subject in the regional limited approval system can clear up the relationship between each subject; Chapter 4th is mainly about the analysis of the legal source and content of the regional limited approval system. Through the analysis of the relevant laws and regulations, the main contents of the regional limited approval system are summarized, including: situation, Chapter 5th is to find out the problems existing in the system of limited approval in the region; chapter 6th gives some legal suggestions according to the problems found in order to make the system of limited approval in the region more perfect and play its due role.
