论我国动物保护立法构建

【摘要】：近年来,随着中国出现的严重虐待动物行为的增多,动物疾病的频繁爆发以及西方国家动物福利贸易壁垒的影响,我国动物保护立法的呼声也越来越高,动物保护立法已经势在必行。针对我国动物保护法的立法构建,本文通过对我国现有有关动物保护法律的梳理与分析,发现目前我国动物保护立法主要有三点缺陷:一是忽视动物自身利益,功利性强;二是相关法律规定少,立法分散;三是监督机制不明晰,执行力差。针对这三点问题,结合国外发达国家的立法经验与我国的具体国情,本文提出三项建议:一是以保护动物福利为前提,明确动物法律地位,二是结合国情规划动物保护立法框架,三是整合社会公益组织力量提高执行力。因此,我国的动物保护立法构建不仅需要借鉴其他发达国家的成功经验,更需要结合我国实际国情,从而真正达到维护动物福利的立法目的。
[Abstract]:In recent years, with the increase of serious animal abuse behavior in China, the frequent outbreak of animal diseases and the influence of animal welfare trade barriers in western countries, the voice of animal protection legislation in China has become more and more high. It is imperative to legislate on animal protection. In view of the legislative construction of animal protection law in China, this paper analyzes the existing animal protection laws in China. It is found that there are three main defects in the current animal protection legislation in our country: first, it ignores the interests of the animals themselves and has strong utilitarianism; second, the relevant laws and regulations are few and the legislation is scattered; third, the supervision mechanism is not clear and the execution power is poor. In view of these three problems, Combined with the legislative experience of foreign developed countries and the specific conditions of our country, this paper puts forward three suggestions: first, to make clear the legal status of animals on the premise of protecting animal welfare; second, to plan the legislative framework of animal protection in the light of national conditions. The third is to integrate the strength of social public welfare organizations to improve the executive power. Therefore, the construction of animal protection legislation in China not only needs to learn from the successful experiences of other developed countries, but also needs to combine the actual conditions of our country. In order to truly achieve the legislative purpose of safeguarding animal welfare.
